Rush Trucking. Speeding Blue Semi Truck on the American Highway. Trucking Concept.Kellog’s Company is facing a personal injury lawsuit from two Pennsylvania men alleging that one of the company’s truck drivers was responsible for a devastating semi truck accident. The plaintiffs allege the driver’s negligence caused the semi truck accident, which left the two men with chronic debilitating pain and permanent health problems requiring continuous treatment.

Pennsylvania plaintiffs Kevin H. and Derrick W. are jointly filing the personal injury lawsuit, seeking compensation for all past and future medical expenses related to the semi truck accident.

The semi truck accident occurred in June 2016. The driver Bobby R is also named as a defendant in the personal injury lawsuit.

According to the lawsuit, the Pennsylvania residents were driving home from a fishing trip with Kevin in the driver’s seat and Derrick in the passenger seat. At some point in their journey, the men encountered the Kellog’s semi truck driven by Bobby R. The lawsuit alleges that Bobby unexpectedly made a left turn into traffic and did not give Kevin enough time to stop. This semi truck accident took place within the state of Pennsylvania on the specific roads referenced in the personal injury lawsuit.

Kevin slammed on the brakes but still hit the side of the truck which caused him to be ejected from the car and slam his head on the side of the truck. Derrick was also ejected from his seat during the semi truck accident, and became sandwiched between the car and truck.

The personal injury lawsuit further alleged the men sustained serious injuries, with Kevin reportedly suffering an actual hole in his head that had required multiple stitches to repair. Derrick suffered contusions, ligament injury and bruising, with both of them reportedly suffering from severe pain and suffering. Furthermore, Kevin continues to suffer from cognitive issues and headaches, and will most likely continue to suffer these injuries for some time to come.

Overview of Filing a Personal Injury Lawsuit

While Kevin and Derrick’s semi truck accident is unfortunate, they were able to file a claim for personal injury liability. Personal injury lawsuits are filed on a daily basis, with claims ranging from semi truck accidents to other serious injuries, with plaintiffs often seeking past and future medical expense related to the injury.

People who are interested in filing a personal injury lawsuit can take several steps to increase their chances of success for their claim including:

  • Collecting evidence, such as photographs or insurance documents
  • Document everything that happened that led to the injury, describing the injury itself, and what happened after the injury including incurring medical bills, hospital visits, loss of wages, etc.
  • Collect names and contact information of any potential witnesses
  • Take notes of conversation with other people involved in the accident or incident that caused injury

Personal injury law guarantees the injured party the right to pursue compensation for their injuries and to file legal action if necessary. Kevin and Derrick are suing Bobby, Kellog’s Company and its subsidiaries for past and future medical expenses, along with any other relevant damages.

This Semi Truck Accident Lawsuit is Case No. 4:18-cv-00433-MWB, in the U.S. District Court for the Middle District of Pennsylvania.
