A Massachusetts couple alleges the husband’s illness is attributable to a link between Roundup and non-Hodgkin’s lymphoma.
The plaintiffs, Larry T. and his spouse Dana D., have filed this formal legal complaint against the Monsanto Co. after Larry repeatedly used Roundup and non-Hodgkin’s lymphoma was later diagnosed by his physician.
Larry and Dana are citizens and residents of Middlesex County, Mass. Larry says he worked as a professional landscaper and property manager, according to the documentation in the lawsuit, for close to two decades.
In these capacities, he regularly used the herbicide Roundup to brings weeds under control and harboring insects. He claims that he followed all safety precautions and directions regarding for application of Roundup and non-Hodgkin’s lymphoma still developed. This disease was officially noted in his health record on April 11, 2013.
During the time that Larry used the herbicide, he says he was not aware of any information indicating that its main ingredient, glyphosate, was a source of danger to animals, marine life, or humans.
The plaintiff says he did not become aware of the alleged linkage between use of Roundup and non-Hodgkin’s lymphoma and other cancers and illnesses until the International Agency for Research on Cancer (IARC) released a review of glyphosate on July 29, 2015.
Larry and Dana bring several claims in their Roundup and non-Hodgkin’s lymphoma lawsuit against Monsanto. The following counts are based on the evidence and belief that the company commercially released a product that is dangerous to human health and continue to promote and maintain it as benign:
Count 1: Negligence; Count 2: Design Defect; Count 3, Products Liability, Failure to Warn; Count 4: Breach of Express Warranties; Count 5: Breach of Implied Warranty of Merchantability; and Count 6: Loss of Consortium.
Together, this married couple are asking for respective compensatory damages be awarded to them through a jury trial. They request that these damages include interest, and all attorney, court, and miscellaneous costs of litigation.
IARC and its Glyphosate Determination
IARC is a specialized global agency related to the World Health Organization (WHO). IARC is specifically charged with conducting its own research and coordinating the research of other entities on the causes of a variety of cancers.
IARC specifically reviewed glyphosate, the active chemical in Roundup, from 2014-2015, analyzing its ability to directly impact human, animal, and marine health. IARC spent a year reviewing data from studies of human and animal DNA. After this year, the agency concluded that glyphosate is a “probable human carcinogen” and classified it as such.
While this information was published in late July 2015, a good percentage of the study data was gleaned from Monsanto itself that had ownership of it since the mid-eighties.
