A class action lawsuit claims that dog food marketed under the Rachael Ray Nutrish brand contains a dangerous weed killer.

The Rachael Ray dog food class action lawsuit was filed by plaintiff Markeith Parks against pet food maker Ainsworth Pet Nutrition LLC d/b/a Rachael Ray Nutrish.

Parks initiated this Rachael Ray Nutrish class action lawsuit on behalf of herself and other people similarly situated who have been harmed by not knowing about the inclusion of glyphosate in the dog food.

The Rachael Ray Nutrish class action lawsuit lodged against the dog food company alleges that the maker’s claims about the health benefits or safety of the food are misleading, deceptive, and false.

Although the products are marketed as being natural, the dog food allegedly includes the chemical herbicide glyphosate. The weed killer dog food lawsuit says no buyer would expect glyphosate.

Glyphosate has been the subject of other lawsuits in recent years, particularly related to use inside the weed killer Roundup. Although the health impacts are not yet fully known, a number of humans allege they’ve developed cancer due to exposure to glyphosate through the Roundup product.

The Rachael Ray Nutrish weed killer dog food class action lawsuit argues that no consumer purchasing dog food with the label “natural” on it would expect dangerous chemicals inside that might expose the dog eating it to health problems.

The consumer products misleading advertising class action alleges that by deceiving customers about the quality and ingredients of the dog food, the makers are able to charge premium prices and sell a larger volume of their products.

Parks says that the false and misleading advertising puts pet owners at a disadvantage since consumers cannot make an informed decision about what constitutes “natural.” However, Parks adds that no consumer would see this label and assume that possible cancer-causing ingredients are found inside the food.

The Rachael Ray Nutrish class action lawsuit is pushing for further analysis and discovery of what’s inside the dog food and the possible impacts of glyphosate. Many crops like soy, corn, and peas are sprayed with glyphosate to produce uniform, high-yield, and early harvest results.

However, as the dog food class action lawsuit argues, there are no health benefits for humans or animals ingesting anything with glyphosate inside. Consumers who discover ingredients inside a product that appears to be counter to the labeling might choose to file a misleading advertising class action lawsuit.

The proposed $5 million Rachael Ray Nutrish dog food class action seeks to represent a nationwide Class of consumers who purchased Rachael Ray dog food marketed as “natural,” in addition to a New York subclass.

The Nutrish dog food class action lawsuit alleges violations of common law, unjust enrichment, breach of express warranty, and violations of New York’s General Business Law.

Parks is seeking resolution in the form of a refund, disgorgement, restitution, and any other monetary damages available in a jury trial.

The plaintiff is represented by Kim E. Richman of Richman Law Group and Michael J. Gabrielli of Gabrielli Levitt LLP.

UPDATE: On April 18, 2019, a class action lawsuit alleging Rachael Ray Nutrish dog food contains a dangerous weedkiller was tossed by a federal judge for lack of specificity.

UPDATE 2: On Feb. 20, 2020, a New York federal judge dismissed an amended class action lawsuit that claims Rachael Ray Nutrish dog food is labeled as being “natural” even though it contains a trace amount of a herbicide.

    My dog just died suddenly of heart problems. He had cancer too. He had been eating Rachael Ray for 5 years. So sad! I hope something is done! Why should our animals have to suffer for their greed.

    I lost 2 of my Australian Shepherds to this dog food! One on July 3rd 2018 and the other on July 29th 2018. I have a Female still that was eating the same dog food and before she would eat she would go out and eat grass every morning before eating her food. After I lost my two males, I seen this announcement about the dog food, so I switched back to Purina Pro Savor and my girl has never ate grass again and for my youngest, I believe I switched him back just in time. How long do you have to wait. I try to find out, but the law firm really doesn’t have a answer other than, they are fighting it! Does it make that people lost something in their lives that was so meaningful and loved. It’s so hard to this day to talk about my beautiful dogs!who got a answer?

      My dog does the same thing eat grass. Swiched back to Purina beneful. He has shedding a lot of also.
      We have an Australian cattle dog.

    I have been trying for the last 3 months to find out why my healthy 110 pounds dog was losing so much weight. The only change in her diet was me feeding her the Rachael Ray Nutrish dog food that I didn’t know had the poison in it until I was told by a close friend when I was talking long distance to on the telephone.

    I have been using this for a little less then a year and i have been wondering if the food is causing some sort of allergic reaction. I have tried multiple proteins but stuck to the same brand since it claimed to be natural. Now im going to try other brands but i would like to be added to the list if this seems like a cause.

    I just lost my dog because of this dog food. Did the formula change? The packaging changed in the summer and at the same time the dog food changed and looked similar to cat food. We bought a brand new bag when our dog became sick because we thought we bought cat food. But as it turns out, it was dog food and our pup did not recover.

      I’m sorry for both of your losses.I lost my girl in May. This has to be if. She was 100 one day, diagnosed with kidney failure the next, gone so quickly. I was feeding my dogs this for years. This is horrific.

    I lost one of my dogs to the Chinese dog food. so did my research I fed my dogs 3 years organic chicken and rice With Rachael Ray’s chicken and brown rice. I buried 2 of my dogs the whole reason that feed them organic food so they live longer and be healthier they were my kids
