A woman has received a $6.3 million award in a bus accident lawsuit. A Los Angeles jury awarded the money on May 16 to a woman who says she was hit by a tour bus as she crossed the street in 2015.
According to the bus accident lawsuit, plaintiff Solia E. allegedly was walking to a doctor’s appointment at White Memorial Hospital on Aug. 24, 2015. While she was crossing the street at the intersection of Cesar E. Chavez Ave. and Boyle Ave., she allegedly was hit by a Prevost tour bus as it was making a right turn. The tour bus was allegedly operated by defendant Gonzalez Travel & Tours Inc.
Even though the defense tried to argue that Solia had fallen before she was struck by the tour bus, expert witnesses allegedly determined that the driver wasn’t thorough with making visual checks and other bus driving protocol.
Solia’s son Jaime is a named plaintiff in the bus accident lawsuit, too, because he was with his mother when the accident occurred. He allegedly suffers “anxiety, nervousness, depression, and severe emotional distress” as a result of seeing his mother suffer the trauma.
The bus accident lawsuit award totals $6,298,237, which includes $2 million for past general damages, $898,000 for past medical expenses, $2 million for future general damages and $1.4 million for future medical.
Bus Accident Lawsuit Alleges Long-Term Injuries
Solia suffered open fractures of both legs and severe degloving injuries, which involves tissue or muscle being torn from the bone. Immediate assistance is necessary because a patient can lose a lot of blood in a short period of time when suffering from a degloving injury. According to her lawyer, Solia has endured multiple surgeries and is permanently disabled.
Solia also now allegedly suffers from Complex Regional Pain Syndrome (CRPS), which is a type of chronic pain affecting her legs. The pain is thought to stem from nerve damage, and symptoms can change over time. According to the bus accident lawsuit documents, she now needs an in-home caregiver.
According to the mayoclinic.org, signs of Complex Regional Pain Syndrome can include:
- Nonstop burning or throbbing pain in an extremity
- Sensitive to cold or touch
- Painful swelling
- Alternately feeling hot and cold
- Skin color changes that might appear white or mottled red or blue like a bruise
- Skin texture changes that appears thin or shiny
- Less uniform hair or nail growth
- Muscle spasms, tremors, weakness, or atrophy
- Impaired mobility of the affected extremity
According to the Mayo Clinic, Complex Regional Pain Syndrome is a rare condition, but doctors believe a combination of inflammatory responses combined with problems in the central and peripheral nervous systems manifest as CRPS.
The Bus Accident Lawsuit is Case No. BC619159, in the Superior Court of California, County of Los Angeles.
