A new lawsuit alleging an Illinois woman developed cancer from Roundup use has been filed against Monsanto in Illinois federal court.
The complainant, Doris W., claims that her cancer and associated injuries occurred as a direct consequence of her use of the herbicide Roundup.
Monsanto is a global chemical manufacturing corporation organized under the laws of Delaware. It maintains its headquarters in St. Louis, where this cancer from Roundup lawsuit was filed in U.S. District Court.
The chemical giant is registered to advertise and sell its herbicidal products in Illinois, where Doris W. lives.
The Plaintiff’s Cancer from Roundup Story
According to the complaint, the plaintiff used the spray-on variety of Roundup for several years. She says that she followed all the manufacturer’s directions and also thoroughly read and implemented all safety precautions listed on the label when using the product.
Despite these efforts, she alleges she was diagnosed with non-Hodgkin’s lymphoma cancer from Roundup use. Non-Hodgkin’s lymphoma is cancer of the lymph nodes, hte producers and filters of the body’s secondary circulatory system of lymphatic fluid which bathes each cell in the body.
Doris W. is bringing five causes of action against the Monsanto Co. to hold them accountable for their alleged contribution to her development of cancer from Roundup use:
The First Cause—Negligence; The Second Cause—Strict Products Liability, Design Defects; The Third Cause—Strict Products Liability, Failure to Warn; The Fourth Cause—Breach of Implied Warranties; The Fifth Cause—Breach of Express Warranty.
The plaintiff is seeking compensatory damages from Monsanto for her physical pain and suffering, mental and emotional anguish, financial losses from medical treatments and loss of income, and a return of costs associated with litigation such as attorney and court fees.
Doris W. is also asking for a jury trial where evidence can be presented accordingly.
A Probable Carcinogen
The International Agency for Research on Cancer (IARC), a division of the World Health Organization (WHO), reviewed glyphosate—the active ingredient in Roundup herbicide products—for a full year prior to March 2015.
That month, it released its conclusions that glyphosate was a ‘probable human carcinogen’. A group of scientists associated with IARC found evidence underscoring an increased risk for the development of non-Hodgkin’s lymphoma cancer from Roundup (glyphosate) use.
This new report by IARC did nothing to remove the evidence trail Monsanto allegedly had access to all along. This trail—spanning several decades–indicated glyphosate’s tendency to mutate DNA and cause problems with human chromosomes, according to this cancer from Roundup lawsuit.
Monsanto continues to promote and advertise its products with little more than a head nod to these ‘unproven’ findings, risking the health of thousands of users, alleges the cancer from Roundup lawsuit.
The Cancer From Roundup Lawsuit is Case No. 4:18-cv-00191-HEA in U.S. District Court, Eastern District of Missouri.
