NuWave Oven Pro Cover Cracks Too Easily, Owners SayIf you purchased a countertop oven made by NuWave within the last three years and your oven’s plastic dome cover has cracked, you may have a legal claim.

Consumer are claiming that the design of the NuWave Oven Pro and NuWave Oven Pro Plus is defective, because the plastic dome cover cracks after normal use. Additionally, customers say that when they try to have this problem remedied by making a claim under the company’s warranty, the company discourages them from doing so.

The company that produces the NuWave ovens, NuWave LLC, may have been aware of the defect, customers say. A recent NuWave class action lawsuit alleges the company continued to sell what it knew was a defective product.

In May 2018, plaintiff Elizabeth Aguilera filed a NuWave class action lawsuit against the company, saying that NuWave knew that the devices were defective and intentionally misled customers as the quality of the devices via advertising and labeling.

She says that the company advertises the ovens as “high-quality,” “dishwasher safe,” “durable,” and “shatter resistant,” which she says are false representations of the product’s quality. Aguilera says that ether NuWave Oven Pro and NuWave Oven Pro Plus ovens have plastic domes that can crack within a year, even if they have been used minimally or entirely normally.

She cites hundreds of complaints made by customers online about the NuWave ovens. She argues that the company knows about the defect, because in many cases, the company responded to the customer complaints.

She says that the company’s promises of durability constitute express warranties about the product, and claim that the company knowingly breached its express warranty by selling a product that did not live up to what was advertised.

Additionally, the NuWave Oven Pro class action lawsuit says that the company intentionally tries to get out of honoring warranty agreements made with customers. Allegedly, the company’s warranty of the NuWave Oven Pro and NuWave Oven Pro Plus promises that the company will provide replacement parts or repairs for the ovens during one year after its purchase.

However, Aguilera claims that when customers attempt to make use of the warranty program to get a replacement dome cover, the company tells them the dome is out of stock. Other customers were allegedly forced to pay shipping and handling costs for the replacement domes. Customers say that these costs are often as expensive as a new oven, and that the practice of charging for shipping and handling contradict’s the company’s warranty policy.

The NuWave lawsuit argues that “in fact, instead of providing customers with free, non-defective replacements for their cracked and unusable Standard Domes, NuWave has a standard practice of manipulating consumers into paying to upgrade to NuWave’s newer, more expensive, Power Dome, an amber-colored dome which is advertised as being ‘virtually indestructible.’”

If you purchased a NuWave Oven Pro or a NuWave Oven Pro Plus in the last three years, the dome of your oven cracked, and you were discouraged from taking advantage of the product’s warranty, you may have a legal claim.

The NuWave Cracked Oven Dome Class Action Lawsuit is Elizabeth Aguilera v. NuWave LLC, Case No. 1:18-cv-03550, in the U.S. District Court for the Northern District of Illinois.
