Three Apple customers have filed a class action lawsuit alleging the tech giant failed to protect App Store users from a fraudulent cryptocurrency wallet app that allegedly stole more than $1.8 million in digital assets.
According to the class action lawsuit, plaintiff James Ramirez and two others downloaded what appeared to be the legitimate Sparrow Bitcoin wallet app from Apple’s App Store after relying on Apple’s longstanding representations that apps available through the marketplace are reviewed, vetted and safe.
The lawsuit alleges the app was instead a spoof designed to steal users’ cryptocurrency by capturing their wallet credentials.
The plaintiffs claim Apple built consumer trust through years of marketing the App Store as a secure marketplace while failing to adequately review, monitor and remove fraudulent applications.
They allege Apple continued making those safety representations despite knowing or having reason to know that fake crypto wallet apps were available through the App Store.
Apple allegedly ignored warnings about fake Sparrow crypto wallet apps
The class action lawsuit alleges Apple knew or should have known fraudulent Sparrow Wallet apps were available in the App Store. It cites a 2024 public warning from the developer of the legitimate Sparrow Bitcoin Wallet, who said fake Sparrow apps remained available despite being reported to Apple.
According to the lawsuit, plaintiff Jalen Delgado downloaded the crypto wallet in May 2025, while Ramirez and Ellis downloaded it in July and August 2025, respectively.
The Apple class action claims each plaintiff entered a cryptocurrency wallet seed phrase into the app before discovering it was fraudulent and that their cryptocurrency had been transferred to scammers. Ramirez alleges he lost about $875,000, Ellis alleges he lost about $840,000 and Delgado alleges he lost about $120,000.
Ramirez and Ellis allegedly reported the fraudulent app to Apple after discovering the thefts, but Apple did not respond to their reports.
The lawsuit further alleges Apple failed to issue warnings, alerts or other notices informing consumers that fraudulent cryptocurrency wallet apps had appeared in the App Store or advising users to independently verify wallet applications before entering sensitive credentials.
The plaintiffs assert claims under California consumer protection law and Louisiana and Massachusetts consumer protection statutes, as well as for fraudulent misrepresentation, fraudulent concealment, negligent misrepresentation and failure to warn.
They seek compensatory, treble and punitive damages, along with injunctive relief requiring Apple to implement stronger procedures to prevent fraudulent applications from appearing in the App Store and to provide clearer warnings to consumers.
In another class action lawsuit, a consumer alleges Apple misled users by advertising Safari as protecting them from online tracking while allowing third parties to track them through browser fingerprinting.
