Class action accuses Amazon of scheming to suppress delivery driver wages

A new class action lawsuit alleges Amazon orchestrated a deliberate and unlawful scheme to suppress the wages of hundreds of thousands of delivery drivers across the United States.

The plaintiff, a former California Delivery Service Partner (DSP) driver who worked routes in Stockton, Manteca and surrounding areas, claims Amazon’s practices force its army of delivery drivers to endure grueling and often inhumane working conditions to earn “bottom of the barrel” pay.

The former driver argues Amazon accomplishes this “grim monopsony” through its Delivery Service Partners, which, he claims, are horizontally oriented companies that provide delivery services for Amazon.

The Amazon class action lawsuit proposes a nationwide class encompassing all individuals who worked as Amazon DSP drivers in the United States at any point from June 1, 2018, through the present, along with several regional subclasses.

Amazon delivery driver lawsuit claims drivers must accept ‘inhumane demands’

The class action lawsuit claims Amazon’s orchestration of the DSP monopsony results in lower wages and worse working conditions for the workers who provide the delivery services for Amazon products.

“DSP drivers themselves have called their working conditions ‘atrocities’ because they must meet inhumane demands like urinating in water bottles to satisfy inhuman delivery requirements,” the Amazon class action lawsuit says.

The plaintiff claims Amazon is able to pay its DSP drivers less than similarly situated workers due to its “outsized market power in labor markets by virtue of its need to deliver a virtually endless supply of household goods.”

“Amazon does not fear that its DSP drivers will leave to work for other employers, and it does not have to improve their compensation or working conditions,” the Amazon class action says.

The lawsuit claims Amazon is guilty of monopsonization of the DSP drivers market, attempted monopsonization of the last-mile delivery drivers market and unreasonable restraint of trade.

In another Amazon class action, consumers claim the company violated consumer privacy laws by secretly collecting and selling data about what consumers watch on Amazon TVs.
