Plaintiff Guadalupe Sweatman brings the class action forward on behalf of herself and all similarly affected customers who purchased or leased a 2013 Nissan Rogue vehicle.

The Nissan class action lawsuit was originally filed in California state court in January, but the case was removed to federal court on Feb. 16, 2018.

Sweatman claims that the vehicles are sold with defective continuously variable transmission, or CVT, and that while the vehicle is in use, the transmission fails in ways that render the vehicle unusable.

According to the Nissan class action lawsuit, a CVT has a continuous range of gear ratios and is designed to allow the vehicle to shift gears while driving in a smooth way. Theoretically, this design that makes it feel as if the vehicle has a gear for every speed. With a CVT, the driver should ideally not feel the gear shifts, or “shift shock.”

Allegedly, the 2013 Nissan Rogue’s CVTs are defective in such a way that makes them prone to failure while the car is being driven. As a result, the cars lose their ability to accelerate. This makes them dangerous to drive, because often times, drivers have to accelerate rapidly to merge and avoid collision.

The Nissan CVT class action lawsuit alleges that consumers have been injured in a range of ways. In some cases, consumers were injured physically when they were involved in car collisions as a result of their vehicles’ stalling transmissions. In other cases, consumers were injured financially, because they had to spend thousands of dollars to repair or replace the CVTs.

According to the Nissan Rogue class action lawsuit, Nissan has been well aware of the CVT defect for some time. They conducted internal testing, and received consumer complaints about the issue.

The Nissan Rogue CVT defect class action lawsuit goes on to say that the company is not only aware of the defect and sold the vehicles to consumers nonetheless, but “routinely denies consumers requests for reimbursement of the expenses incurred in connection with the transmission defect.” Allegedly, the car company “has not remedied the transmission defect, has not compensated consumers for the damages resulting from the defect,” even when the cars were under warranty.

Sweatman claims that she would not have purchased the 2013 Nissan Rouge had she known that the car had a defective continually variable transmission. In addition to seeking damages for herself and other similarly affected consumers, she aims to have Nissan remedy the CVT defect or stop the sale of defective cars and preserve the safety and confidence of consumers.

A similar class action lawsuit over the same issue was filed in November 2017 regarding alleged CVT defects in the 2012-2013 Nissan Versa vehicles.

Sweatman is represented by Adam Rose of the Law Office of Robert Starr.

    My wife bought a 2013 Nissan Rogue in March 2013 and the transmission went out in February 2023 with less than 75000 miles with no prior warning signs or problems. Cost of transmission with labor is $5800 at the local Nissan.

    Bought a 2013 Nissan rogue . I actually loved it to be honest .. thats why it is so upsetting to not have the money to fix it . But to read the hundreds of comments and stories people are posting online about the same exact situation I experienced is beyond ridiculous. It’s a 2013 obviously any issue has been brought up and discussed 10 years down the road. I just CAN NOT believe there hasn’t been more accountability apologies and some type of action to make things right. This is going to financially kill me. Especially since my fiancé cars engine stopped just a few months ago. Leaving us with 3 daughters and no car. Just recently buying our first home. It’s overwhelming quite honestly. And I’m at a loss. Any information about anything Nissan is doing for the 2013 Rogue would be appreciated.

    2013 Nissan Rogue as well, mechanic said he can’t find anything wrong with it and to check for recalls because transmission is shot but shouldn’t be yet. No recalls for faulty parts on this car, I’ll never recommend it to anyone or get another car from them again. Clearly a parts issue based on what I’ve found online yet they have showed no accountability and are causing people to get hurt.

    I have a 2012 nissan rogue with a ctv trans in it luckly the semi driver didnt crash into us as we had our two kids in the car when the trans just blew up. Now were down to one car and things are not looking good going in to winter for our small family.

    2013 Rogue, 142000 miles and our transmission failed. We are 5 months out of warranty, but still have 13 months left of payments. It’s going to be $4300 to replace and we just dont have it. I have not contacted Nissan, but it sounds like that would be a waste of time anyway. But if they were aware of this issue, then they should be responsible.

    I have a 2013 nissan rogue my transmission was changed after months of researching and complaining to nissan corporate and getting a case number but i did have time scared to death on the freeway and road because i tought i was going to off the road or somebody was going to crash me from behind. Can i join the case?

    Can we still file on the law suit? I spend $3400 to replace transmission on a 2016 rogue in April of last year. It broke down yesterday. Warranty was only one year

      I have complained about the CVT since 2017. It made a hissing sound and Iit never brought codes up. I finally had to replace it in October 2022. I had a problem with the air bag where it would come and go off. I was in an auto accident May 2022 and everyone es airbags deployed except mine. I had a concussion and my air bag light won’t go off. I took it in to have it checked and no codes were spitting out
      Since my air.bag Lightfoot go off it brought up a code today the clock spring air bag need replaced. NISSAN M corporate has been very proactive regarding my concerns.

    Hi I have a 2014 Nissan Rogue and I’m having problems with the transmission, I replace the transmission last year and it last just one year and I’m having the same issues again took it to Nissan dealership and they said they can’t find any problems with it, nissan send the specialist to check on in and said that, the transmission starting to have issues, and now Nissan doesn’t want to replace it because it doesn’t have warranty any more. The new transmission it only last 1 year. I won’t buy any Nissan cars any more.

      I purchased my 2013 Nissan Rogue in 2017. My transmission kept slipping on the highway, as I was traveling home from college. I had the local Nissan dealer look over it before my warranty expired, with NO HELP. I still had years remaining for payments and ultimately, had to replace the transmission (2xs). This has been a heartbreaking experience. I sent in complaints, filed recall requests, with No avail.

    I purchased a 2016 Nissan Rogue 1 year ago. I started having problems a few months in to owning it. The gas pedal at times has a 3 to 4 second delay which has scared me to death when pulling out into traffic… I have to ride the gas and the brake at the same time to make sure the car will move. Also the transmission will not glide into the next gear and just tacks out … I have to pull off the road ,,, shut it off and pray it works correctly. This has caused a few near miss collisions. The check engine light finally came on… so now I can have it repaired at the dealership I purchased it at, but now the issue is they have no loaner vehicles for me to use. Im at a loss here.
