Plaintiff Guadalupe Sweatman brings the class action forward on behalf of herself and all similarly affected customers who purchased or leased a 2013 Nissan Rogue vehicle.

The Nissan class action lawsuit was originally filed in California state court in January, but the case was removed to federal court on Feb. 16, 2018.

Sweatman claims that the vehicles are sold with defective continuously variable transmission, or CVT, and that while the vehicle is in use, the transmission fails in ways that render the vehicle unusable.

According to the Nissan class action lawsuit, a CVT has a continuous range of gear ratios and is designed to allow the vehicle to shift gears while driving in a smooth way. Theoretically, this design that makes it feel as if the vehicle has a gear for every speed. With a CVT, the driver should ideally not feel the gear shifts, or “shift shock.”

Allegedly, the 2013 Nissan Rogue’s CVTs are defective in such a way that makes them prone to failure while the car is being driven. As a result, the cars lose their ability to accelerate. This makes them dangerous to drive, because often times, drivers have to accelerate rapidly to merge and avoid collision.

The Nissan CVT class action lawsuit alleges that consumers have been injured in a range of ways. In some cases, consumers were injured physically when they were involved in car collisions as a result of their vehicles’ stalling transmissions. In other cases, consumers were injured financially, because they had to spend thousands of dollars to repair or replace the CVTs.

According to the Nissan Rogue class action lawsuit, Nissan has been well aware of the CVT defect for some time. They conducted internal testing, and received consumer complaints about the issue.

The Nissan Rogue CVT defect class action lawsuit goes on to say that the company is not only aware of the defect and sold the vehicles to consumers nonetheless, but “routinely denies consumers requests for reimbursement of the expenses incurred in connection with the transmission defect.” Allegedly, the car company “has not remedied the transmission defect, has not compensated consumers for the damages resulting from the defect,” even when the cars were under warranty.

Sweatman claims that she would not have purchased the 2013 Nissan Rouge had she known that the car had a defective continually variable transmission. In addition to seeking damages for herself and other similarly affected consumers, she aims to have Nissan remedy the CVT defect or stop the sale of defective cars and preserve the safety and confidence of consumers.

A similar class action lawsuit over the same issue was filed in November 2017 regarding alleged CVT defects in the 2012-2013 Nissan Versa vehicles.

    We have a 2016 Nissan Rogue which we bought on 1/1/16 and now has 114,840 miles and now all the sudden the transmission slipping and jerking. Took it to Nissan dealer charged $140.40 to hook it up to their computer and gave us a quote if $5389.36 to replace their CVT. When we purchased this vehicle from the dealership down I clear Lake Tx we were not aware of these CVT problems that Nissan is having, even though we purchased the extended warranty of course we had over 100,000 miles so of course no coverage.

    i have a Nissan 2017 Rogue that is having transmission problems and the mechanic is telling me it needs replaced for 4700.00 I bought this car used and it only has about 67000 miles on it. I am on a fixed income and it appears there are several people with the same problem Nissan should make a recall on this and make this right.

    I had a 2011 Nissan Rogue that had the transmission fail and a 2012.Suzuki (Uses a Nissan CVT transmission) that failed. Same problem as these newer vehicles described. I lost thousands of dollars. Wish there had been a class action to help me recover.

    This is ridiculous I need to file a class action lawsuit my 2013 Nissan Rogue is giving me lots of trouble & Money with the problems that is going on with it the mechanic say it is my cvt is bad now & needs to be repair I can’t afford to fix anymore parts on it with no money, I’m on a fixed income & I just don’t have the cash to fix it I already spend $3200 in getting a another engine because something had my engine running hot & is gone now it’s my cvt going out which I have no idea of what’s that is My car has been in shop since about 3 weeks now & I need to get back & forth from work with no other transportation available, I needs help NOW?? please contact me as soon as possible

    Had 2013 Rogue, started having transmission problems at 92,000 but finally went at 104000, so they would not cover cost. Spent 3700 would like to get reimbursed or in on suit

    My 2013 Nissan Rogue has the same problem because there is not a transmission cooler on the vehicle. The dealer said it had overheated 60 times. I thought all automatic transmissions had a cooler. This is a design flaw.

    I have a 2014 rogue same issue with transmission, dealer comfirmed cvt problems, had to replace. My car was in dealer shop for 3 weeks until i got it back, had but 2 days for car rental expense offer. This is unacceptable. Add me please, I do have documentation on all the repairs i had on this vehicle. Besides the CVT problems.

    This is so bad I just had to have mine replaced and paid over 3k which I had went to the dealer in regards to an issue of that I would be driving on the highway and my car would shut down or wouldn’t get in gear to move. I got I would have to pay to diagnose the problem then I have to come out of pocket. Worse customer service and car I have ever gotten
