Disability Insurance Claim FormA Florida woman has filed a new lawsuit against Unum, alleging the insurance giant wrongfully denied her ERISA disability claim.

According to the lawsuit, the plaintiff was totally disabled and unable to work, yet after filing her ERISA disability claim, Unum denied her the benefits to which she was rightfully entitled.

The plaintiff, Rhonda O., worked for years as an Associate Professor of Sociology at Rollins College, and holds a PhD. Under the terms of her contract with Rollins College, Rhonda was covered under long-term disability insurance through Unum Life Insurance Company of America.

However, Rhonda became no longer able to work because of a few serious debilitating conditions, including Neural Immune Disorder and Fibromyalgia Syndrome. Indeed, the lawsuit notes that the U.S. Social Security Administration itself has determined that she was “disabled from any gainful employment.”

Upon filing her ERISA disability claim several years ago, Unum initially granted approval in January 2011, determining that she was totally disabled and qualified for full benefits. Unum continued paying Rhonda’s benefits for four years when suddenly, the lawsuit claims, the company decided to cut her benefits off.

This disability claim reversal comes despite the fact that Rhonda’s conditions had not improved, and she was no more able to return to work then than she had been for years previously. Despite this, Rhonda’s ERISA disability claim and subsequent benefits were terminated.

Rhonda maintains that Unum’s reversal on her ERISA disability claim was wrong, and began pursuing litigation as a final attempt to reclaim her benefits. The ERISA disability claim lawsuit was filed on August 2, 2017 in the U.S. District Court for the District of Massachusetts.

Filing an Unum ERISA Disability Claim Denial Lawsuit

A growing number of plaintiffs like Rhonda are filing disability benefits lawsuits against Unum, claiming that the insurance giant unfairly denied their ERISA disability claim to benefits that they qualify for under the terms of their insurance policies, often provided by employers.

This Unum ERISA lawsuit and others like it allege that Unum, as the largest disability insurance company in the country, has unfairly denied disability insurance claims of plaintiffs who are qualified to receive such benefits.

Some lawsuits go further, alleging that the company purposely denied the claims of hundreds of thousands of workers with legitimate disabilities for no reason other to increase company profit.

Former employees of Unum have reported being instructed to purposely deny insurance to people with legitimate claims to disability benefits in order to fulfill the company’s quota.

Consumers who have exhausted all recourse through applications and appeals for disability benefits may turn to filing a lawsuit over denied disability benefits, hoping to reverse Unum’s denial.
