Mitsubishi class action lawsuitMitsubishi Fuso Truck of America Inc. installed defective emissions control systems in some of its diesel powered trucks, according to a class action lawsuit filed Monday in New Jersey federal court.

Plaintiff Q+Food LLC, a Florida company in the business of selling and delivering seafood, filed the class action lawsuit, which alleges Mitsubishi Fuso’s BlueTec engines are equipped with a defective exhaust emission control system that can cause vehicles to malfunction. According to the class action lawsuit, the engines were designed to comply with the U.S. Environmental Protection Standards for on-highway diesel engines.

The Mitsubishi class action lawsuit alleges that Mitsubishi Fuso issued a press release in 2009 to announce that “its EPA 2010-emissions compliant commercial trucks will use engines equipped with BlueTec technology developed by Mitsubishi Fuso and Daimler AG. BlueTec is an emissions control technology that utilizes selective catalytic reduction (SCR) to reduce nitrogen oxide (NOx) emissions for clean, efficient operation.”

However, Q+Food alleges the BlueTec technology, when adapted and installed on diesel-powered, medium duty trucks, has caused the trucks to suffer from a number of issues, including the repeated failure of the diesel exhaust fluid handlers, the fluid injectors, the catalytic converter muffler, the engine protection system, lack of power and “numerous other problems that have caused the trucks to stall or not restart.”

“In short, all medium duty trucks with the BlueTec technology sold by Defendant have manifested a model-wide defect causing operational failures about which purchasers throughout the country have continuously complained,” the BlueTec engine defect class action lawsuit says. Q+Food claims that the defect has caused trucks equipped with the BlueTec technology to be inoperable for extended periods of time, costing their owners thousands of dollars in replacement vehicle costs, back-up trucking expenses and lost work.

Q+Food alleges that out of the 790 days it owned the Mitsubishi Fuso truck with BlueTec technology, it was out of service for at least 250 of those days. According to the engine defect class action lawsuit, this experience is not unusual.

The Mitsubishi class action lawsuit charges the car company with breach of warranty, breach of the duty of good faith and fair dealing, violations of the New Jersey Consumer Fraud Act, and declaratory relief under the Declaratory Judgment Act.

The plaintiffs are represented by Natalie Finkelman Bennett and James C. Shah of Shepherd Finkelman Miller & Shah LLP, Michael D. Donovan of Donovan Axler LLC and Robert W. Murphy.

The Mitsubishi BlueTec Engine Defect Class Action Lawsuit is Q+Food LLC v. Mitsubishi Fuso Truck of America Inc., Case No. 1:14-cv-06046, in the U.S. District Court for the District of New Jersey.

    I PURCHASED A NEW 2016 FUSO FE160
    It’s got 6800 miles ,been to dealership (Jim Reed’s Truck Sales) 5 times and is there now!!!.
    Most of the miles are from going back and forth to them

    They keep passivating me.
    Transmission is nothing but a piece of shit. They that’s the way it is bullshit!!
    I have been driving for over 50 years and this truck sucks
    Buyer beware
    I’m paying Insurance ,monthly payments are $870.14
    And the God dam truck is in there shop , and I’m unable to operate
    Very, Very ,Very Totaly Disapointed

    complete lemon 2012 FUSO

    Towing back to dealer cost even under warranty were killing us.

    Dont but FUSO — look at Hino a little more $ but so far well worth it

    I filed a claim when will settlements be paid out. I thought this was settled and deadline for claims was June. This doesn’t seem right. Who do I contact about this.

    I have a 2013 Fuso FE 180 that has been an absolute nightmare! 3 transmissions, water pump, radiator, Def tank replaced,(Twice) and needs to be replaced again! Won’t start in weather below 0! I am afraid to run this rig. Now out of warranty with only 90,000 miles.

      I’ll bet that the components are being replaced because the service folks don’t actually want to diagnose things. I’ve got a 2012 FG 4×4, on the second transmission, second DEF tank, some replaced harnesses, and they also replaced all exhaust sensors (O2, NOX, etc), along with PCV valve assembly and the other recalls like low pressure fuel line. There’s also apparently a DPF/DEF system recall that will replace everything from the turbo back, but it’s being held up for some reason. They’ve been talking about it for at least two years now with no resolution.

    I purchased a 2012 Fe 160 in July to start a new business. The truck is doing its best to bankrupt my new business. The DEF system just shut us down on a run and put the truck into limp home mode from lack of DEF but the tank was full. I had to have the truck towed. They wanted me to pay almost $3000 for a new tank but now I hear of all these other problems and have had to look into having the DEF system eliminated. That too is costly ($3500) but at least it won’t just fail again. My truck is out of warranty anyway so I have no choice but to eliminate the defective system or have the truck put me out of business as it is the only truck I have to depend on. If anyone is in the same boat with the DEF system I have found a guy that can eliminate it. Please add me to this lawsuit! My e-mail is TwoKnightsRecovery@gmail.com

    hola, tengo un fuso fe 180 2014, tiene 28000 y siempre me da una alarma de engine amarilla y roja y enciende la senal de DEF
    adema , mientras manejo ,enciende la senal de aceite y se apaga inmediatamente , alguien tiene esta experincia ?
