Mitsubishi class action lawsuitMitsubishi Fuso Truck of America Inc. installed defective emissions control systems in some of its diesel powered trucks, according to a class action lawsuit filed Monday in New Jersey federal court.

Plaintiff Q+Food LLC, a Florida company in the business of selling and delivering seafood, filed the class action lawsuit, which alleges Mitsubishi Fuso’s BlueTec engines are equipped with a defective exhaust emission control system that can cause vehicles to malfunction. According to the class action lawsuit, the engines were designed to comply with the U.S. Environmental Protection Standards for on-highway diesel engines.

The Mitsubishi class action lawsuit alleges that Mitsubishi Fuso issued a press release in 2009 to announce that “its EPA 2010-emissions compliant commercial trucks will use engines equipped with BlueTec technology developed by Mitsubishi Fuso and Daimler AG. BlueTec is an emissions control technology that utilizes selective catalytic reduction (SCR) to reduce nitrogen oxide (NOx) emissions for clean, efficient operation.”

However, Q+Food alleges the BlueTec technology, when adapted and installed on diesel-powered, medium duty trucks, has caused the trucks to suffer from a number of issues, including the repeated failure of the diesel exhaust fluid handlers, the fluid injectors, the catalytic converter muffler, the engine protection system, lack of power and “numerous other problems that have caused the trucks to stall or not restart.”

“In short, all medium duty trucks with the BlueTec technology sold by Defendant have manifested a model-wide defect causing operational failures about which purchasers throughout the country have continuously complained,” the BlueTec engine defect class action lawsuit says. Q+Food claims that the defect has caused trucks equipped with the BlueTec technology to be inoperable for extended periods of time, costing their owners thousands of dollars in replacement vehicle costs, back-up trucking expenses and lost work.

Q+Food alleges that out of the 790 days it owned the Mitsubishi Fuso truck with BlueTec technology, it was out of service for at least 250 of those days. According to the engine defect class action lawsuit, this experience is not unusual.

The Mitsubishi class action lawsuit charges the car company with breach of warranty, breach of the duty of good faith and fair dealing, violations of the New Jersey Consumer Fraud Act, and declaratory relief under the Declaratory Judgment Act.

The plaintiffs are represented by Natalie Finkelman Bennett and James C. Shah of Shepherd Finkelman Miller & Shah LLP, Michael D. Donovan of Donovan Axler LLC and Robert W. Murphy.

The Mitsubishi BlueTec Engine Defect Class Action Lawsuit is Q+Food LLC v. Mitsubishi Fuso Truck of America Inc., Case No. 1:14-cv-06046, in the U.S. District Court for the District of New Jersey.

    I have a 2010 fe145 that I bought new with the diesel motor, I’ve developed a lower engine knock and it only has 52,000 miles on the truck!! Now I’m trying to get it fixed in Pittsburgh pa and nobody wants to work on it. Tried calling bowser which is where I bought it but they informed me that they were shutting there commercial truck repair doors.. with no info where I can find help? Nothing from Mitsubishi, no help anywhere. So now I’m looking at trading it in and they only want to give me 16 k for a truck I paid 50k for. Beyond frustrated !! Never buying a Mitsubishi again

    I have this truck for three years and changed every thing on turbo was changed all sensors was changed the dpf was changed also the def was changed and trani was changed three times the truck is nothing but a headache and it buts you out of bussiness it coast alot of time loss alot of customers and alot of money for rentals

    I didn’t know about this class action until I search it up. My company has a 2012 Fuso that in the shop for the pass month and they can’t get it fix. Same problems like many of you, engine light on/can’t start. Stopping in the middle of the road. Cant believe it! How do I join this class action?

    I have a 2008. Pre blue tec. No problems other than cracked trannya cooler, various relays, fuel dump into crank case during regen and getting parts from USA OR JAPAN.

    We have a 2013 Fuso with exact problems … it has been in the shop more than it has been in use and has cost us thousands of dollars in revenue. We want to be part of this class action lawsuit … we want a buy back as well. Please keep us informed about the latest on the lawsuit.

    We have a 2012 fuso fe180….Nothing but problems from day one…third transmission, over 10k in rental cost while truck is broke down…the longest the truck has run without the engine light going on is three weeks….emission controll system out of warranty…so now costing thousands in breakdowns….In toronto Canada you cannot call Mitsubishi Fuso, their phone number is unlisted,no email address,You can only contact the dealer and they will contact Mitsubishi Fuso for you…Go Figure..

    I have a 2012 also its now on its third transmission with only 11000 miles on it. No one informed me when I purchased the truck of the recurring problems with the transmission. Now I am stuck. What happens when its out of warranty, I pick up the cost?

    i have a 2012 and nobody wants it including dealer. i dont dare use it past warrenty so it sits usless.

    This is no surprise. In addition to engine issues, the Duonic Transmission has turned out to be a disaster with thousands of failures, recalls, rebuilds, electronic upgrade and after each failure a statement it is now fixed. However even the new 2015 models are having the same issue. Horrible design and exactly what would be expected with putting a Fiat Engine together with a Semi-Automated transmission with no real world testing. Fuel economy due to constant regenerations is only one of the issues. Customers are experiencing downtime and weeks in the shop with no support from Fuso to compensate. This is only the tip of the iceberg, a complete failure of what once was a great truck. Blame the leadership in the US for letting this horrible truck hit the roads.
