A group of Pennsylvania residents is suing a debt collection agency in a Midland robocall lawsuit claiming the company unlawfully called them.
The Pennsylvania Record reports that several residents in Montgomery County, Pennsylvania, are alleging that Midland Credit Management Inc. has violated the Telephone Consumer Protection Act by unlawfully contacting them to collect debts.
Plaintiffs Cynthia Colacchia, Karina Avesian, Elizandra Cruz, Samantha Duval, John Morris and Beth Richino-Brown have jointly filed a Midland robocall lawsuit all claiming that they have sustained damages from being called multiple times on their cell phones. They allege that Midland Credit Management, through their agents, did this to collect debts.
The plaintiffs in the Midland robocall lawsuit are holding both Midland Credit Management and Midland Funding responsible for the damages because they called the plaintiffs without obtaining prior consent.
In this Midland robocall lawsuit, the plaintiffs are requesting a trial by jury and would like to prevent the Midland from making any more calls to the plaintiffs. They are seeking actual damages, statutory damages in the amount of $500 per call, the costs of court as well as any other damages that the court may deem fair.
According to its website, Midland Credit Management is a “company that helps consumers resolve past-due financial obligations.” They also state that, “when a lender does not receive payment on an account for a specific amount of time, they may decide to close your account and turn it over to collections.”
Midland says that “many lenders sell the right to collect on your account to companies like Midland Funding LLC or one of MCM’s affiliate companies.”
This Midland Robocall Lawsuit is Case No. 2:17-cv-00411-TJS in the U.S. District Court for the Eastern District of Pennsylvania.
What is the Telephone Consumer Protection Act?
The Telephone Consumer Protection Act, or TCPA, is a law passed by the United States Congress in 1991. The TCPA was signed into law by President George H. W. Bush and amended the Communications Act of 1934.
The TCPA limits telephone solicitation (telemarketing) and puts restrictions on the use of automated telephone equipment.
It also puts restrictions on automated dialing systems, prerecorded or artificial messages, SMS text messages as well as fax machines. The TCPA states that businesses may not call residences using an artificial voice or a recording and that they may not call those on the National Do Not Call Registry.
If a TCPA violation is discovered, a subscriber may sue for up to $500 per violation. If the violation was determined willful, the subscriber may sue for up to three times that amount, $1,500, for each violation.
