McDonald’s stabbing lawsuit overview: 

  • Who: The estate of Matthew A. Maguire filed a lawsuit against McDonald’s, its corporate entities, and the owner of a North Philadelphia McDonald’s location. 
  • Why: Maguire’s estate claims negligence on behalf of the defendants makes them liable for Maguire’s fatal stabbing death in a North Philadelphia McDonald’s parking lot in July 2021. 
  • Where: The lawsuit was filed in the Court of Common Pleas of Philadelphia.

A lawsuit has been filed against McDonald’s by the estate of Matthew A. Maguire, a man who died after being attacked and stabbed by unknown assailants in a Philadelphia parking lot at one of the fast food chain’s locations. 

McDonald’s, its related corporate entities, and the owner of the Philadelphia location where the attack took place have been accused of negligence in the death by allegedly not implementing adequate security measures. 

Maguire’s estate argues McDonald’s had a duty to ensure its parking lot was safe for patrons, and that, after the attack on July 13, 2021, workers failed to do anything to assist him. 

“Although Plaintiffs’ Decedent suffered serious injuries and was visibly overcome by the assault, the Defendants’ employees/agents/security personnel failed to render any aid or assistance while he was assaulted,” the McDonald’s lawsuit states.

The Mcguire estate claims McDonald’s had no security personnel monitoring the parking lot, despite there being “many prior assaults to business invitees and persons in the surrounding area of which the defendants knew or should have known.” 

McDonald’s, the Mcguire estate argues, was ultimately negligent in a number of ways, including with the hiring and training of its workers, failing to conduct a crime audit, and failing to use an adequate amount of security cameras, among other things. 

“Plaintis’ Decedent’s injuries were the direct and proximate result of the negligence of the Defendants and their agents,” the McDonald’s lawsuit states. 

Mcguire’s estate is seeking damages under Pennsylvania’s Wrongful Death Act on behalf of his two minor children, along with additional damages for negligence under the state’s Survival Act

Several McDonald’s franchisees agreed last month to pay nearly $2 million to resolve claims by the Equal Employment Opportunity Commission that they subjected their workers to sexual harassment and a sexually hostile workplace.
