Victims of the Mandalay Bay shooting who were inside the gates when the shooting happened may be eligible for legal assistance and compensation.
On Oct. 1, 2017, a horrific shooting left 58 people dead and 546 injured at the Route 91 Harvest music festival. The shooter stockpiled weapons and ammunition in his Mandalay Bay room over the period of a few days, allowing him to open fire on individuals attending the music festival below the hotel.
Victims of the Mandalay Bay shooting are still suffering from physical injuries, emotional injuries such as PTSD, and financial burdens from medical bills, missed work, and counseling.
Thousands of victims have applied for financial aid from state programs which provide assistance for victims of violent crimes. Additionally, a non-profit Las Vegas Victims Fund has been established to distribute nearly $22 million that was raised in the days and weeks following the Mandalay Bay shooting.
However, despite the physical and emotional injuries victims have sustained, many have reported being turned away after they were deemed “not injured enough” for financial assistance. These victims may be eligible to join countless others in legal action. Lawsuits have been filed against MGM Resorts International, the owner of Mandalay Bay Resort; Live Action, the Route 91 Harvest festival organizer; and the $5 million estate of the deceased gunman.
Plaintiffs have accused MGM of not having adequate security policies, not properly training staff, not properly surveilling the premises, and negligently allowing the shooter access to a service elevator, which allowed him to transport and stockpile weapons in his room before the shooting. Lawsuits argue that the Mandalay Bay staff should have noticed the shooter’s behavior and that more proactive security protocols could have alerted law enforcement of the problem before the shooting occurred.
Plaintiffs have also accused Live Nation of failing to provide enough exits, failing to properly train employees, and failing to utilize loudspeakers and other technology to broadcast evacuation instructions during the Mandalay Bay shooting. In the weeks following the shooting, many victims criticized the festivals organization, claiming that blocked exits and unprepared staff may have contributed to the sheer volume of injured victims.
Plaintiffs have accused the shooter’s estate of assault, battery, and intentional infliction of emotional distress. As the obvious perpetrator of the Mandalay Bay shooting, lawsuits hold his $5 million estate accountable for his crimes.
Filing a Mandalay Bay shooting lawsuit could help recover compensation needed to address injuries. The pressure of legal action could also force companies to implement updated safety protocols to make Vegas a safer place and prevent further tragedies. Although legal action is commonly complicated and lengthy, a qualified attorney could help injured victims recover assistance that they would not be able to get elsewhere.
