A new plaintiff has filed a talcum powder lawsuit against Johnson & Johnson, alleging that his late wife died from ovarian cancer caused by the use of talcum powder.
The plaintiff, Jorge R., is a resident of California, and filed his talcum powder lawsuiton behalf of his late wife, Julita R.
According to the talcum powder lawsuit, Julita used baby powder from Johnson & Johnson as part of her daily hygiene routine throughout her entire life. Unfortunately, she was later diagnosed with ovarian cancer, and ultimately died from the serious illness. According to Jorge’s lawsuit, Julita’s illness and subsequent death from ovarian cancer was directly caused by her prolonged use of Johnson & Johnson baby powder.
Jorge’s talcum powder lawsuit was filed on multiple counts, including failure to warn, design and manufacturing defect, negligence, breach of express and implied warranties, fraudulent concealment, fraud, and wrongful death, among others. Jorge filed the lawsuit on Jan. 4, 2018 in the U.S. District Court for the Northern District of California.
Jorge is far from the first to file a talcum powder lawsuit over ovarian cancer injuries. Much of this litigation has been consolidated into multidistrict litigation, or MDLs.
Baby Powder and Ovarian Cancer
Baby powder has been a popular product for generations, and not just for use with babies. While baby powder is primarily used to prevent diaper rashes in babies, it is also often used for adult hygiene as well. Some baby powder products are even advertised as being useful for adults, including Johnson & Johnson’s baby powder. Many women have used baby powder as part of their daily feminine hygiene routines in their genital area.
Unfortunately, the use of talcum-based baby powder products in the genital area has been linked with ovarian cancer, a particularly dangerous form of cancer. In fact, ovarian cancer is the fifth leading cause of cancer deaths in U.S. women, according to the National Cancer Institute.
According to a growing number of lawsuits, Johnson & Johnson has allegedly encouraged generations of women to use its talcum-based baby powder products as part of their hygiene routine. Lawsuits state that Johnson & Johnson actively misrepresented the actual safety of its product, concealing its risks.
Filing a Talcum Powder Lawsuit
If you or someone you love has used Johnson & Johnson’s Shower to Shower or a similar talcum-based baby powder product as part of a regular hygiene routine, and have since been diagnosed with ovarian cancer, you may be able to file a talcum powder lawsuit.
While filing a talcum powder lawsuit cannot take away the pain and suffering of ovarian cancer, and cannot bring a loved one back to life, it can help to alleviate the financial burden caused by medical expenses and lost wages.
The Talcum Powder Lawsuit is Case No. 3:18-cv-00052, in the U.S. District Court for the Northern District of California.
