A man is filing a Swift truck accident lawsuit against the trucking company alleging the company is liable for the serious injuries he suffered in an accident caused by a semi-truck.
Plaintiff Lorinzo M. filed the Swift truck accident lawsuit in Louisiana federal court demanding a trial by jury. The lawsuit was filed on Aug. 2, 2018.
According to the Swift truck accident lawsuit, Lorinzo was a resident of Tangipahoa Parish, La. at the time of his accident.
He says that on Sept. 30, 2017 he was driving a 2003 Chevrolet Cavalier automobile while the driver employed by the trucking company was driving a 2015 Great Dane 18-wheeled truck. They were both driving southbound on Interstate 55 in Tangipahoa Parish, La.
Lorinzo says that he was driving in the left lane and the Swift driver in the right. However, as they approached an on ramp from Louisiana 16 onto Interstate 55, Lorinzo alleges the truck driver veered left without warning and crossed the “center line of the road” into Lorinzo’s lane.
To avoid a collision, he says he was “forced to veer left as well, which caused his vehicle to leave the road.” Lorinzo’s “vehicle then struck the cable barrier system located in the median in a violent manner,” the truck accident lawsuit adds.
The Swift truck accident lawsuit accuses the driver of careless operation, failure to stop, failing to see what should have been seen, failing to follow rules of the state of Louisiana, failing to maintain reasonable and proper vehicle control, operating the vehicle in a careless and reckless manner, and of failing to keep a good and careful lookout.
Overview: Swift Truck Accident Lawsuit
Across the United States, thousands of trucking accidents happen–nearly 500,000 each year. Of that number, nearly 5,000 accidents end in fatalities. Throughout the last 20 years, trucking accidents have increased by 20 percent. Many factors have contributed to that growing number of accidents. These factors include:
- Driver fatigue
- Alcohol or drug use
- Lack of maintenance
- High speeds
- Brake problems
- Road and weather conditions
- Weight, load or size imbalances
- Lack of driver training/lack of experience
- Cell phone usage/distracted driving
- Violation of federal trucking laws and regulations
Sadly, motorists are much more likely to be injured in a semi-truck accident than an accident with another passenger vehicle due to the disproportionate sizes of the vehicles involved.
For victims who have suffered from trucking accidents, they may be eligible to purse a substantial amount of money including other recoveries for their damages. Pursuing recovery through a trucking accident lawsuit may be able to assist with some of the following:
- Loss of wages and loss of future earning potential
- Vehicle damage
- Total past and future medical expenses
Additionally, in situations involving trucking accidents, trucking companies can also held responsible for the damages they have caused to other drivers and passengers. If you or a loved one have suffered from the actions of truck drivers in a trucking accident, an attorney can help you determine what role the trucking company has in the accident.
The Swift Truck Accident Lawsuit is Case No. 2:18-cv-07357-ILRL-MBN, in the U.S. District Court for the Eastern District of Louisiana.
