Majestic Pure essential oils are not “100% Pure and Natural” despite the company’s representations, according to a class action lawsuit filed earlier this month in New York federal court.

Plaintiff Precious Williams accuses Epic Business Services Inc. d/b/a Majestic Pure Cosmeceuticals of marketing and advertising its essential oils around false claims that appeal to health-conscious consumers by stating that  the products come from natural plant origins.

She points to statements on the Majestic Pure website which stress that its products are “made from simple and pure botanical ingredients” and that its botanical oils are “100% pure, free from any additives or adulterants.”

Williams claims that the representations that Majestic Pure oils are “100% Pure and Natural” are false, deceptive and misleading because they contain “a spectacular array of artificial and synthetic chemicals.”

According to the Majestic Pure class action lawsuit, testing of the company’s essential oils have shown that the products are “adulterated with man-made synthetic compounds and unlisted ingredients that unnaturally sweeten or otherwise alter the aroma and profile of the oils and/or make its oils less expensive to produce.”

In some cases, Majestic Pure oils contain toxic components such as diethyl phthalate, a possible carcinogen, the essential oils class action lawsuit says.

“Defendant’s statements are false and misleading to a reasonable consumer because … the Products contain synthetic and toxic chemicals and, as such, are not ‘100% Pure and Natural,’” Williams says in the Majestic Pure class action lawsuit.

Williams alleges that she and the putative Class Members relied on Majestic Pure’s representations that the products were “100% Pure and Natural” when they purchased the products. According to the Majestic Pure class action lawsuit, consumers paid a premium for the essential oils over comparable products that did not make representations that they were “100% Pure and Natural.”

The Majestic Pure products named in the essential oil class action lawsuit include:

  • Lavender Essential Oil
  • Peppermint Essential Oil
  • Clove Leaf Essential Oil
  • Rosemary Essential Oil
  • Myrrh Essential Oil
  • Frankincense Essential Oil
  • Lemon Essential Oil
  • Thyme Essential Oil
  • Bergamot Essential Oil
  • Geranium Essential Oil
  • Tea Tree Essential Oil
  • Jasmine Essential Oil
  • Eucalyptus Essential Oil
  • Roman Chamomile Essential Oil

The Majestic Pure class action lawsuit asserts claims for violations of consumer protection laws of all 50 states, violation of New York business laws, violation of the Magnuson-Moss Warranty Act, and breach of express warranties.

Williams filed the Majestic Pure class action lawsuit on behalf of herself and a proposed Class of consumers throughout the United States who purchased the essential oils for personal use and not for resale during the applicable statute of limitations. She also seeks to represent a New York subclass.

The Majestic Pure essential oil class action lawsuit seeks monetary damages, injunctive relief, actual damages, punitive damages, attorneys’ fees and costs, and other relief deemed appropriate by the court. Williams is also seeking an order requiring Majestic Pure to accurately label its products.

Williams is represented by Michael J. Gabrielli of Gabrielli Levitt LLP.

The Majestic Pure Essential Oils Class Action Lawsuit is Precious Williams v. Epic Business Services Inc. d/b/a Majestic Pure Cosmeceuticals, Case No. 1:18-cv-04270-RA, in the U.S. District Court for the Southern District of New York.
