A Tennessee woman is seeking compensation after allegedly suffering injury in a big rig accident.
Plaintiff Suzanne G. has filed a truck accident lawsuit against a trucking company, alleging the company’s driver’s negligent actions were at fault for the big rig accident that caused her serious injuries.
The claim is naming Load Express LLC as the defendant, along with truck driver Faisal Ali Shegow, who she claims was responsible for the big rig accident.
Big Rig Accident Details
According to the lawsuit, the big rig accident occurred on Sept. 16, 2016, in Whitfield County, Ga. at approximately 4:31 p.m. During this time, Suzanne says she had reportedly been driving her Honda Civic CRV northbound on I-75 in the left lane while the Load Express truck had been driving in the middle lane.
According to the claim, Suzanne’s car was struck on the right side, with the impact causing her to be pushed onto the left shoulder. When the car came to a final rest off the road, it was reportedly facing north in uneven lanes that were under construction.
Not long after the big rig accident, the Georgia State Patrol reportedly responded after being called to the scene. According to the lawsuit, the Georgia State Patrol found truck driver Faisal Ali Shegow at fault for the accident.
Suzanne sustained serious injuries from her accident with the truck, and has had to resort to legal action to collect compensation for these injuries.
Overview of Truck Accident Investigation
Approximately 500,000 truck accidents occur throughout the United States every year, with 5,000 of these incidents being fatal and over 100,000 incidents causing serious injury. These fatalities often consist of consumer class drivers operating small sedans or other smaller vehicles, which can be crushed under the weight and size of an 18 wheel truck.
More specifically, recent statistic reports have found that the number of truck accidents have risen by 20 percent in the last 20 years, with one in eight fatal traffic accidents being linked to 18 wheelers. Due to the sheer size of the trucks the drivers are often unharmed; 98 percent of truck accident fatalities are people driving or passengers in the smaller cars.
There are a number of reasons that could cause a big rig accident to occur, but it has been alleged many are due to the truck drivers having too little sleep and having tight deadlines to meet. While there are federal regulations in place to ensure that drivers get enough sleep, there are other factors beyond the driver’s control, like weather conditions, that can impact them.
In addition, trucking companies often have their drivers go through drug testing to prevent unsafe driving behavior on the road.
People who experienced a big rig accident and suffered serious injuries could file legal action to seek potential compensation. Trucking companies may have to pay various damages a claimant incurs, including medical expenses, property damage, missed work, or other inconveniences.
Suzanne filed this truck accident seeking these and other related damages, including counts of negligence.
This Big Rig Accident Lawsuit is Case No. 4:18-cv-00161-HLM, in the U.S. District Court of Northern Georgia, Rome Division.
