A Unum Life Insurance lawsuit over disability insurance filed by eye doctor alleges the company wrongly denied him necessary insurance.
The plaintiff, Dr. Mark J., is an eye doctor that had been issued a policy from Unum Life Insurance in September 1987.
The lawsuit claims the Unum disability insurance policy would kick in if a disability prevented him from performing the material duties of his occupation.
According to the disability insurance filed by eye doctor lawsuit, the plaintiff worked as ophthalmologist, a specific kind of eye doctor whose primary practice consists of performing cataract surgeries.
Although Unum allegedly insured Dr. Mark J. for his work as an ophthalmologist who performs cataract surgeries, after he filed his disability claim, Unum claimed on October 7, 2013 that these cataract surgeries were not considered an integral part of his practice.
The plaintiff appealed this decision on March 27, 2014, noting that these surgeries were, in fact, essential to his position as an ophthalmologist, but Unum again denied his claim on January 21, 2016.
Having exhausted all administrative means of contesting Unum Life Insurance’s denial of the claims for disability insurance filed by eye doctor, the plaintiff turned to litigation.
According to the disability insurance filed by eye doctor lawsuit, “Unum has not provided a reasoned basis, vocational or otherwise, explaining why [the plaintiff] is not entitled to benefits under terms of the Policy.”
The lawsuit was filed on counts of breach of contract and breach of implied covenant of good faith and fair dealing.
