An injured plaintiff stood before a jury this month, saying that Johnson & Johnson has actively covered up the baby powder cancer risks linked with their product for years.
The plaintiff, Deborah G., allegedly developed ovarian cancer after using a Johnson & Johnson baby powder product on her genitals. Deborah urged the jury to find Johnson & Johnson liable for her cancer diagnosis.
According to Deborah’s attorney, Johnson & Johnson has been encouraged since at least 1982 to update their warning labels to reflect the possibility of ovarian cancer diagnosis as a result of baby powder cancer risksassociated with product use.
However, Johnson & Johnson has not provided warnings to its customers about the possible link between using its talc-based baby powder products in the genital area and ovarian cancer.
It is this negligence, says Deborah’s attorney, that led to her Stage 4 ovarian cancer. On top of the cancer itself, complications from her treatment also reduced her life expectancy.
“She has literally had her spleen removed, part of her stomach removed, part of her colon removed, all of her ovaries, uterus. She has literally had basically the lower half of her body removed,” her attorney said. “She said if there would have been a warning on the bottle to not use this on the genital area, she would not have done it and we might not be here.”
J&J Denies Baby Powder Cancer Risks
Johnson & Johnson continues to argue that there is no solid connection between talc-based baby powder and ovarian cancer.
Johnson & Johnson attorney David E. Dukes said that the several respected medical institutions, including the U.S. Food and Drug Administration (FDA) and the Centers for Disease Control and Prevention, had looked for a link between talc and ovarian cancer, yet had found no such link.
Despite Johnson & Johnson’s firm stance that there is no solid link between talc powder and ovarian cancer, the pharmaceutical giant has actually already been hit with massive ovarian cancer lawsuit losses this year.
First, in February, $72 million was awarded to the estate of a deceased ovarian cancer patient who had used Johnson & Johnson baby powder for decades. According to reports, this was the first case in which Johnson & Johnson was ordered to pay these kinds of damages over baby powder cancer risks.
Another case, this one from May, resulted in a $55 million verdict in favor of the plaintiff.
While filing a baby powder cancer lawsuit cannot take away the pain and suffering of someone who has been diagnosed with cancer, or bring a loved one back to life, it can help to compensate for the financial expenses often incurred by medical bills and lost wages.
If you or someone you love has used Johnson & Johnson’s Shower to Shower baby powder, or a similar talc powder product, and have since been diagnosed with ovarian cancer, you may be able to file a lawsuit over baby powder cancer risks.
The Baby Powder Cancer Lawsuit is Case No. 1422-CC09012-01, in the 22nd Judicial Circuit Court of the State of Missouri.
UPDATE: On Oct. 27, 2016, a Missouri jury handed down a $70 million verdict to Deborah G., finding Johnson & Johnson liable for her ovarian cancer.
