Las Vegas Shooting Lawsuit Filed on Behalf of Surviving Children of Mom Killed at FestivalA Las Vegas shooting lawsuit has been filed on behalf of the surviving children of a woman shot and killed in the Route 91 massacre last year.

Forty-year-old California waitress Candice B. had gone to the Route 91 Music Festival with friends. She was separated from her friends during the chaos and could not be found. She was shot and died of her wounds, leaving behind a 20-year-old son, 16-year-old daughter, and 2-year-old niece she had just adopted in May 2017.

Negligence, Wrongful Death Alleged in Las Vegas Shooting Lawsuit

Several defendants are named in this Las Vegas shooting lawsuit, including the festival organizers and the owners of the hotel from which the gunman opened fire.

MGM Resorts International owns the Mandalay Bay Resort and Casino Las Vegas, where the shooter stayed in a room and aimed at the crowd from his window. Stephen Paddock allegedly brought approximately 25 firearms to his hotel room. He was a known high-stakes gambler, and as such, he allegedly received special treatment, including access to the service elevator to haul all of his luggage.

According to the Las Vegas shooting lawsuit, Paddock purportedly had hotel staff help him haul his heavy luggage up to his hotel room on the 32nd floor of Mandalay Bay. Among his ten pieces of luggage were rifles equipped with bump stocks which allow a semi-automatic rifle to shoot rapid-fire, imitating the action of an automatic weapon.

According to the Las Vegas shooting lawsuit, Paddock hung a “Do Not Disturb” sign on his hotel room door during his stay, keeping even maid staff from entering his room. He installed security cameras so that he could monitor the hallway. Either no one questioned his actions or perhaps no one saw him installing this equipment in the hallway. He also allegedly barricaded the door that led from the stairwell to the hallway of the 32nd floor of Mandalay Bay.

MGM Resorts Festival Grounds LLC owns the premises where the Route 91 music festival took place, the open-air Las Vegas Village. MGM Resorts, along with concert promoters and organizers Live Nation Entertainment Inc. and One Nation Group LLC, are accused of failing to develop emergency protocols and failing to secure an adequate number of exits to protect attendees in the event of any violent acts occurred during the Route 91 Music Festival.

Contemporary Services Corporation, dba C.S.C., was the security vendor on site hired to provide security during the Route 91 Festival. C.S.C. is accused of failing to properly train and supervise employees on how to respond in the event of a violent act or other emergency.

Stephen Paddock, deceased, was the perpetrator of the mass shooting during the Route 91 festival. Because he took his own life right after he stopped shooting at the crowd, the estate of Stephen Paddock is named as a defendant. Paddock planned and carried out the horrific act of violence that left 58 innocent people dead and nearly 500 injured.

The Las Vegas shooting lawsuit alleges Paddock “intentionally and maliciously caused the death” of Candice Bowers “when he opened fire from his hotel room at the Mandalay Bay on the crowd of attendees at the Route 91 Festival on the grounds of the Las Vegas Village.”

The Las Vegas Shooting Lawsuit is Case No. 2:18-cv-05647,  in the U.S. District Court for the Central District of California.
