joes-jeans-inc-logoJoe’s Jeans and Hudson Clothing shoppers only have a few more days to file a claim for the “Made in the USA” class action settlement.

The deadline to file a claim for the Joe’s Jeans and Hudson Clothing class action settlement is June 20, 2017. Class Members can file a claim for either a tote bag or t-shirt. The tote bag is valued at $55 and the t-shirt is valued at $68.

The settlement resolves allegations that the clothing companies misrepresented where some of their clothing was made when they put “Made in the USA” on their products.

“Consumers generally believe that ‘Made in USA’ products are of higher quality than their foreign-manufactured counterparts,” alleged the plaintiffs in their class action lawsuit. “Due to Defendants’ scheme to defraud the market, members of the general public were fraudulently induced to purchase Defendants’ products.”

Class Members include consumers who purchased Joe’s Jeans or Hudson Clothing products between Jan. 7, 2011 and Dec. 31, 2015 that included an unqualified label indicating they were “Made in USA.”

No proof of purchase is necessary, but the Claim Form asks Class Members to voluntarily provide the model, Style Number, or SKU (a string of letters and numbers) of the item of clothing they bought, along with the month and year they purchased the item.

Additionally, Class Members must agree under penalty of perjury that they purchased a Joe’s Jeans or Hudson Clothing Company product with an unqualified “Made in USA” or “Made in the USA” label on it.

Class Members’ legal rights are affected whether or not they act. Class Members who fail to file a claim on time will not be able to file at a later date. The date for Class Members to exclude themselves from the lawsuit and thus not be bound by the terms of the settlement is June 20, 2017; however, those who exclude themselves will not be entitled to a tote bag or t-shirt. The date to object to the settlement agreement has already passed.

According to the class action lawsuit, Joe’s Jeans and Hudson Clothing Company mislead consumers by including unqualified “Made in USA” or “Made in the USA” labels on products whose components did not originate in the United States. The class action claimed that the clothing companies violated California’s false advertising laws.

In addition to the valuable tote bag or t-shirt, Joe’s Jeans and Hudson Clothing Company have agreed to revise the “Made in the USA” labels on their products.

The parties entered into a settlement agreement on May 9, 2017. Final approval of the settlement agreement is set for a hearing on July 28, 2017.

Class Members can learn more about the settlement on the Joe’s Jeans, Hudson Clothing class action settlement page or by visiting JoesJeansSettlement.com.

The plaintiffs and Class Members are represented by John H. Donboli of Del Mar Law Group LLP.

The Joe’s Jeans Class Action Lawsuit is Jeff Card v. Joe’s Jeans Inc., et al., Case No. 37-2015-00021834-CU-BT-CTL, in the Superior Court of the State of California for the County of San Diego.
