A growing number of consumers are reporting that they were denied disability insurance coverage to which they were entitled.
Unum Life Insurance Company of America has been hit with a number of lawsuits regarding improperly denied disability insurance coverage. Consumers who have been denied disability insurance coverage they believe they should rightfully have been paid may be able to pursue litigation.
One such woman who was recently denied disability insurance coverage joined the growing pile of litigation against Unum. The plaintiff, Stacy F., alleges she was an employee of Marvin’s Flower Gardens, Inc. up until August 2, 2014. Because of her employment, Stacy was covered under a group Long-Term Disability Plan through Unum. During her employ, however, Stacy says she was diagnosed with disabling conditions: dysfunction of the cervical, lumbar, and thoracic spine, which prevent her from performing her regular duties.
Initially, Stacy was granted short term disability benefits from around August 2014 through November 2, 2014. Even her long term disability claim was approved at first, and paid through November 30, 2016. But she was denied disability insurance coverage ever since that point. In response, she filed an appeal, believing the denial to be unfairly issued.
Stacy’s appeal was denied, but she appealed one more time in December 2017. The second appeal, too, was denied, leaving Stacy with no further administrative methods of seeking her proper insurance coverage.
She did have one approach left open to her: litigation. Stacy filed a lawsuit on March 20, 2018, alleging her long term disability claim was wrongfully denied.
Denied Disability Insurance Coverage
Stacy is far from the first person to have been denied the benefits she was rightfully supposed to receive under Unum policy. Some disabled consumers seek reinstatement of their disability benefits by pursuing more administrative means available to them, including filing appeals to reverse the decision.
However, even when a person attempts to appeal, as in Stacy’s case, Unum may still deny this appeal. After the appeal approach proves unsuccessful, some turn to litigation to seek the company’s claim denial reversal going forward.
A growing number of plaintiffs like Stacy have begun filing lawsuits against the insurance giant.
This Unum disability insurance lawsuit and others like it allege that Unum has unfairly denied the disability insurance claims of plaintiffs who are qualified to receive such benefits. Some lawsuits go further, alleging that the company purposely denied the claims of hundreds of thousands of workers with legitimate disabilities for no reason other than to increase company profit. Indeed, Unum is both the insurer of the plan’s benefits as well as the plan administrator, and is therefore responsible for deciding who qualifies for benefits—a serious conflict of interests, some claim.
Filing a Unum Disability Insurance Lawsuit
Consumers who have exhausted all recourse through applications and appeals for disability benefits may turn to filing a Unum disability insurance lawsuit over claim denials, hoping to reverse Unum’s decision.
