United States military veterans, active members, or their family members may be able to file an IED Iraq lawsuit, if they got hurt due to a roadside bombing incident in the country.
With injuries also reported in Afghanistan, numerous veterans and active members of military service have been negatively impacted by these events and may potentially be able to file an IED Iraq lawsuit.
The Department of Defense discovered that Iran allegedly supplied dangerous IED and EFP weapons to terrorist groups in Iraq and Afghanistan. While there were sanctions in place to help prevent this, Iranian officials allegedly sought out different foreign banks willing to help supply these weapons in exchange for kickbacks.
Under United States federal law, military veterans and current servicemembers may be able to file an IED Iraq lawsuit against Iran and certain foreign banks for allegedly sponsoring terrorism. The United States Antiterrorism Act allows veterans and active military servicemembers who become injured or disabled due to an IED attack to seek compensation for their injuries through an IED Iraq lawsuit.
The law states that “[a]ny national of the United States injured in his or her person, property, or business by reason of an act of international terrorism, or his or her estate, survivors, or heirs, may sue therefor in any appropriate district court of the United States and shall recover threefold the damages he she sustains and the cost of the suit, including attorney’s fees.”
The act also applies to potential claimants who were injured or killed in Afghanistan, with family members also able to file legal action against Iran and the banks for allegedly supplying these weapons to terrorist groups in Iran.
Overview of EFP or IED Attack Allegations
The weapons involved in this litigation include IEDs (Improvised Explosive Devices), EFPs (Explosively Formed Penetrators), and IRAMs (Improvised Rocket Assisted Monitors), all weapons used in roadside bombings in Iraq and Afghanistan.
According to a 2006 issue of the British newspaper The Telegraph, it was found that Iran alleged manufactured a large number of IEDs and EFPs. Administrator and the 2011 Chairman of the Joint Chiefs of Staff Mike Mullen confirmed that weapons were being sent to Shiite extremist forces in Iraq and that top Iranian government officials were fully aware of this.
“Iran is very directly supporting extremist Shia groups, which are killing our troops. [T]hey are shipping high-tech weapons in there—RAMS, EFPs—which are killing our people and the forensics prove that,” Mullen said.
Even though Congress placed sanctions on Iran to prevent this, Iranian officials reported went to foreign banks to get around the sanctions in exchange for large financial kickbacks.
Banks that have pleaded guilty and reached settlements include: HSBC of UK, BNP Paribas of France, and Germany’s Commerzbank. The banks agreed to pay billions to the United States for allegedly processing illegal transactions that were banned with Iran and other countries allegedly sponsoring terrorism.
United States military veterans, active servicemembers, and family members may have legal recourse against the financial institutions allegedly involved in the conspiracy. Potential claimants should contact a lawyer to determine eligibility for an IED Iraq lawsuit.
