Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automaker’s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasn’t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the owner’s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldn’t be, damaging the combustion and exhaust systems.

This allegedly causes “abnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.”

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customers’ warranty claims even when the warranties have expired. 

According to the lawsuit, Hyundai can’t adequately repair the oil consumption problems and doesn’t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, “and in most cases do not receive required engine replacements.”

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011–2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles. 

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

    Hola yo compre una 2018 Hyundai Tucson 1.6 turbo nueva y tiene tan solo 17 mil millas y está consumiendo aceite y mi esposa compro una del 2017 y está igual cada mil millas se consume más de un cuarto de aceite y la lleve al diler y ellos la están chequiando cada mil millas y Mira lo que me le isieron le echaron un cuarto y medio demás para cuando yo la lleve alas cien mil millas este a nivel y como que no está consumiendo aceite siembre chequeen el aceite antes de salir del diler están asiendo eso y yo medí de cuenta al otro día que tenía demás y me dio un coraje y fui al diler y le réglame que yo quería ablar con el gerente y no me lo buscaron y le dije que le sacaran el aceite que le pusieron de más y la pasaron para el area de servicio y se lo sacaron y tanbien las trasmiciones tienen problema porque cuando tú arrancas brincan las dos que tengo asen lo mismo está brutal estén pendiente cuando las lleven

    I have a 2013 Kia Optima. I check and put oil in my car daily. I have done it for the past 3 years. I took it to the dealer for them to say yes it warrants and qualifies for a replacement, but I have to wait until the engine gives out. At that time I would need to have it towed at my expense to them and they would start the process. The car is still running, thanks to me putting oil in it everyday, but it gets costly when you still have a note. This was my 3rd Kia, I really did like the car, however after being a loyal customer I will not be purchasing one again. Oh, when I took it to the dealer, he said they would do some type of soak..or something, he said it works 85% of the time…to fix the oil consumption issue that no one can tell where its going…Oh did I mention I am on my 3rd catalytic converter??? The soak didn’t work, did the oil consumption test, 500 miles I was already low…and they did nothing and I still had to pay for the service, and I am still buying a 5qts from Amazon to not spend so much money on the quarts…this is really ridiculous…last kia for me…I hope they do win, and how can I get added…

    I have a Hyunday Sonata 2027 and today I check the enginer oil to me surprise this don’t have nothing I add 2 quarters of oil and check again the enginer this only get to mark of haf oil lever my car have 120000 miles was two months ago that I make the change oil. I make the oil change every 5,000 mile with full synthetic oil. I am living in Florida state.

    My daughter’s 2016 Hyundai Sonata burns a quart of synthetic oil every 200-300 miles. I have replaced PCV value and it did not help. This gets expensive and is not right.

    Purchased 2016 Hyundai Santa Fe Sport 96k from a dealership, oil was clean. 4000 miles later get oil changed, told it was low. Next oil change told low off the dipstick. No I know I got a problem. Last week checked, down 2 quarts only 2k since last oil change. Need help!

    I own a 2014 Kia Soul and my engine seized on the highway driving home from DC. I had it towed 40 miles to the dealer and was told that there was no oil in my car, which should have been impossible since I had changed it only 4-5 weeks prior and only driven less than 1,500 miles. Kia told me it was a known issue and I needed to wait out the class-action suit to see if I would eventually get a new engine. Was told that I need to clean my spark plugs and check my oil/replace it every week. EVERY WEEK. What gets me is that the mechanic at the dealer knows its a major problem, knows I need a new engine but won’t give me one.

    Same 2018 Santa Fe Sport. Dipstick was dry but caught it before damage. Go e thru three consumption tests an engine cleaning and another consumption test. Low oil everytime. Last I checked service guy says since I am over 50k I may get a rebuild. But I think the problem may have been here a while and no one including me was looking at the oil level. I want to argue for a new engine. And to boot they have no rental cars. Ahhhhhh!

    My 2019 Hyundai Tucson just seized and on I-5 yesterday and had to have it towed 150 miles home. We had no real warning. My son was driving it home from college about five hours away and in that amount of time it lost all of its engine oil and seized up. We suspected so many things besides the oil. When we checked the dipstick, there was literally NO oil on it! We were stunned! We have never had this problem with any of our vehicles and we have had many. Especially a newer vehicle, this should not have happened. This vehicle has less than 20,000 miles. We are not sure what to do next.
