  • Court approval of the dismissal was not required as the class had not been certified nor proposed to be certified for purposes of a settlement, according to court documents.

Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automaker’s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasn’t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the owner’s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldn’t be, damaging the combustion and exhaust systems.

This allegedly causes “abnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.”

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customers’ warranty claims even when the warranties have expired. 

According to the lawsuit, Hyundai can’t adequately repair the oil consumption problems and doesn’t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, “and in most cases do not receive required engine replacements.”

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011–2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles. 

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

    I have. 2020 Hyundai Palisade SEL, and it’s high oil consumption sometimes few weeks after oil change.

    Had a 2014 Sonata and legit burned so much oil so fast I lost all the oil in it and was forced to trade it in because they wouldn’t replace the engine. So then I was stuck buying a new car I couldn’t afford.

    I have a 2020 Hyundai Palisade with only 18k miles on it and it’s using oil as well. Had an oil change only 1500 miles ago and it’s already down 1/2 quart. Not happy.

    Burning oil and requires weekly topping up.

    i own a 2017 hyundai sante fe sport and its burning up all the oil like crazy went to dealer they did consumption test would check every 1000 km and top up with fresh oil eventually said it have to burn 3 litres or engine stall before they will repair it , it sounds like a diesel engine right now am hoping you guys can help

    I have 2017 Hyundai santa fe sport and it’s burning oil like hell. I complained to Hyundai but they only did engine cleaning which didn’t solve the problem. When I went back to let them know the problem still persist, I was bounced around like a ping pong (meanwhile, my warranty expired in the process) and later told me my warranty had expired and they refused to do anything about it. Now I drive around with 5quarts of oil in my trunk. Pls add me hopefully this injustice can be solved.

    I own a 2016 Hyundai Veloster Base with the 1.6L Gamma GDI. Car had just under 88,000 miles on it when I bought it. It now has just under 104,000 miles and in the year and couple months I have owned it I have had to replace the entire exhaust, including both catalytic converters because the main one stopped up. Then the motor started having a very pronounced knocking noise in the bottom end. Oil was changed every 3000 miles, and was always 2 1/2 quarts or more low on oil at time of oil changes. Local dealer wanted $1300 for just 1 catalytic converter plus labor. $110 for diagnostic fee to tell me the converter was bad. $110 for bearing clearance test. Wanted me to pay almost $600 for a more in depth diagnosis as to why the engine started knocking, so they could try to get it replaced under the extended engine warranty that Hyundai put out on it. Did an oil change on July 2nd and went to drive the car to the gas station, oil light popped on, car stalled and now I have a seized engine. Dealer now wants to perform another bearing test on it……. Yes with a seized engine, go figure. But also want $600 to tear down the engine just to see what caused the failure with no guarantee that they would be able to get the engine replaced under the warranty. I am in a very crappy situation now because of this. And they will not touch the car until I pay the fee and Hyundai corporate was of absolutely no help on the matter either.

    2015 Sonata Sport, burns oil like crazy. I have to add a qt every friday just to keep it at safe levels. WILL NEVER BUY A POS Hyundai again!!!!! Ill definitely be keeping an eye on this lawsuit and keeping track of all the oil I purchase and when put into the car.

    I have a 2018 Hyundai Tucson or is burning oil and constantly putting oil in it. I tried to reach out to the dealer today. I have to keep oil in my car all the time and constantly checking the oil. It sucks.
