Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automakerโ€™s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasnโ€™t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the ownerโ€™s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldnโ€™t be, damaging the combustion and exhaust systems.

This allegedly causes โ€œabnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.โ€

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customersโ€™ warranty claims even when the warranties have expired.ย 

According to the lawsuit, Hyundai canโ€™t adequately repair the oil consumption problems and doesnโ€™t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, โ€œand in most cases do not receive required engine replacements.โ€

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011โ€“2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles.ย 

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

    My 2018 Kia Optima Ex has โ€œcancerโ€. It only has 81,000 miles on it and for some reason there are a plethora of issues going on that started for no reason. The CAT needed to be replaced because the engine is doing something to cause the valve gasket to go bad and leak oil into the CAT. Not only that but itโ€™s ruining the spark plug and a hose. We are talking $6,000+ to fix a 4 year old $26,000 car that only has 81,000 miles (mostly highway miles). I canโ€™t even with Kia right now.

    My 2018 Santa fe sport 2.4l uses 1.5 qts about every 1000 miles even after jumping through their hoops with the engine cleaning. and was told when I asked what I do now and the service man said โ€ Put oil in itโ€โ€ฆ

    Please email me and tell me how I can sign my mother up for this Class Action lawsuit, her 2016 Hyundai Sonata burns oil quickly. She has less than 90K miles on this, from what I know, sheโ€™s the 2nd owner on this crap car. No one should have to purchase and carry jugs of oil in their car, this is ridiculous. Wanted to purchase a new engine for her, but whatโ€™s the point if weโ€™re going to have the same issues.

      Donโ€™t get a new engine! I was lucky enough to get Hyundai to replace engine under warrantyโ€ฆ45k in to new engine and it too burns thru oil like crazy, and has completely stalled while driving twice. Since replacement parts only warranty for 1 yr, Hyundai told me to get lost. They have done nothing to resolve the issue, so a new engine is going to fail tooโ€ฆjust a matter of time.

    Same issue with our 2018 Tucson. Was told to bring it back after 1000 miles to check again. The woman at the service desk said it is a well known problem but there are multiple fixes they have to try before replacing. Ours is at 115,000 miles & warranty is extended thru 120k. Itโ€™s been documented so hopefully Hyundai takes care of this since the problem has already started. Sign us up!

    I would love to be added to the list. My 2017 Sonata is taking 3 quarts between being changed every 2500mi because Iโ€™m afraid of losing it

    My 2015 Hyundai Elantra has been losing oil for quite some time. When I would take it in for service at the dealership, I have brought it to their attention. So called diagnostics ran but no solution. I have to constantly check oil levels and add when low. My mechanic tells me that I need a new engine and to contact Hyundai to verify if there have been recalls on the 2015. I am told by the dealerships, contacted two that there are no engine recalls.I went on line and put my vin # in, nothing. I have contacted the corporate office and am awaiting an reply which I donโ€™t think will happen.

    2013 Sonata same issue. Started burning excessive amounts of oil was told the Hyundai engines run rally hot. Was adding oil about every 500 miles. Took to shop sue to hesitation upon accelerating and was told my catalytic converters were plug from the oil burning. Could replace those for $5,000 but still have oil burning issue. To also replace engine total repair would be $12,500. Hyundai said they wonโ€™t consider looking at it for the other engine recall until converters have been replaced and engine completely fails. So off to the junk grave yard it goes with 144,000 miles and good body/interior condition. Will never buy another Hyundai

    Ive had my 2016 Hyundai sonata for almost 3yrs & it burns excessive amounts of oil I always thought it was just me.

    2016 Sonata burned all the oil out and stalled on the road three times this past week. I am expecting and due very soon and cannot afford a new engine. Dealership and Hyundai Motors denied my claim even after oil consumption was the proven issue. Add me to the list asap!
