  • Court approval of the dismissal was not required as the class had not been certified nor proposed to be certified for purposes of a settlement, according to court documents.

Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automaker’s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasn’t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the owner’s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldn’t be, damaging the combustion and exhaust systems.

This allegedly causes “abnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.”

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customers’ warranty claims even when the warranties have expired. 

According to the lawsuit, Hyundai can’t adequately repair the oil consumption problems and doesn’t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, “and in most cases do not receive required engine replacements.”

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011–2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles. 

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

    I Have a 2016 Hyundai Santa Fe Sport. with 130000 miles. I have change the oil on my car every 5k miles with full synthetic oil. I noticed I have been losing oil and have done a oil consumption test with my Hyundai dealer, which does not know why this is happening. I loose about a quart every 650 miles. I have contacted Hyundai national customer service and they will do nothing about it. Found this web site an I am amazed how many of us are all having the same issue. Something needs to be done about this to protect us the consumer who have paid so much for these cars.

    2016 Hyundai Sonata. My car needs oil every 1000 miles. Its ridiculous thr amount of money I am spending on oil. I have did oil consumption tests the whole nine yards. My extended warranty ran out and was told I need a new engine. Hyundai Corporation offered to pay half of the engine cost of 7,000.00. I would like to join!

    My 2017 Hyundai Sante Fe is currently in the shop since 6/4 and today I get a notice that i need additional information for them to fix my car. My car would not make it to the 3K miles after an oil change. I only have 66k miles on my car. I was excited to know and reason I purchased the car was because of our warrant–and know i ask myself why if thet won’t honor it??

    2019 Hyundai Tucson is burning oil like crazy and I have to keep putting oil in. I’d like to join the lawsuit! I never missed a maintenance check up and I have had two oil consumption reports done. Hyundai isn’t doing anything and I’m so over it

    How do I join this? I’m going through the same thing right now. I’ve already had to replace engine components at other shops due to the dealerships lack of response of even getting an appointment. Finally, they are submitting to Hyundai for a new engine — I’m currently in my 1,000 mile test after not having my car for the past 2 weeks, with no rental or ride share stipend. 2019 Tucson.

    2016 Tucson Hyundai purchased brand new. Mileage as of today 78,000. Have to check oil between oil changes. Having to add 1-2 quarts. Paid for an extended warrant. Dealership had me pay for a tune-up which wasn’t necessary. Dealership said they were going to have to do a fuel flush and that I would have to bring back the vehicle every 300 miles.

    I have a 2016 Hyundai Sonata Sport edition. after a break down that occurred in April 2021, my car started to burn thru oil every 500-800 miles. After my last oil change in April 2022, it got me to New Jersey and before leaving, like I have been doing since I noticed my oil was burning, I checked the dipstick for oil levels, and there was none on the dipstick. I have taken it to different mechanics and they cant find anything wrong with it. I then stumbled upon this article, and want to be contacted about this please!

      My 2018 Hyundai Tucson has had regular oil changes and I’m just under 100,000 miles. I was not notified about an oil consumption recall. I started having issues and asked a mechanic to look at it and that’s when I was informed and begun looking into this. Called a dealership to fix the issue and they won’t even give me a loaner vehicle want me to pay out of pocket for my own!! Please someone tell me what we are doing with this!!
