Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automakerโ€™s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasnโ€™t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the ownerโ€™s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldnโ€™t be, damaging the combustion and exhaust systems.

This allegedly causes โ€œabnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.โ€

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customersโ€™ warranty claims even when the warranties have expired.ย 

According to the lawsuit, Hyundai canโ€™t adequately repair the oil consumption problems and doesnโ€™t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, โ€œand in most cases do not receive required engine replacements.โ€

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011โ€“2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles.ย 

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

    Have just noticed my 2015 tuscon is using oil. This is after the dealer said they would do a consumption test. After the test the dealer said it was all ok.
    I have just added 2 litres of oil and this is before the next service is due. Will definitely have to keep a close check on this.

    I have a 2013 Santa Fe Turbo that is excessively consuming engine oil, additionally, have had transmission issues, and my fuel economy is decreasingโ€”a mini-nightmare in this current economy. Iโ€™ve made an appointment with a dealer, a month out from now, in which they have told me that they will test the engine in order to verify whether it needs to be replaced. Hereโ€™s hoping! Also, guess what, Hyundai has just this year come out with a lifetime powertrain warrantyโ€”this is why they are even looking at my car. Hyundai knows theyโ€™ve messed up, and they SHOULD rectify it!

    2018 Santa Fe is doing this as well. Oil light just came on so when I checked the oil, nothing was showing on dipstick. 2 qts of oil later and barely touching the bottom of dipstick. Dealership claims thereโ€™s nothing wrong with it.

    I purchased a 2013 Hyundai Santa Fe and I change the oil every 3000 miles, however we noticed I was using oil in between changes. At least 1-3 quarts every 1000-1500 miles. Upon taking it in to have oil changed today I put 1.5 quarts in on Friday and it was empty On Monday. No leaks on the outside. However there is a problem on inside to cause this issue. Can I be added to your suit because at this point my SUV is not going to last long

      My 2017 Hyundai Santa Fe sport has been consuming so much oil. I just put 4 qts in a week and a half ago and itโ€™s already low, like in the red low. So my local dealer has submitted my case to Hyundai and now have to do their song and dance to see if they will cover it.

    2016 Tucson, Same oil consumption problem, burning oil every under 1000km now. same issue, link no oil light or indication of low oil, engine stop, I changed cat convertor as Hyundai dealer ask me to change, but no improvement, engine still burning oil, and auto mechanic have no idea why. I am in Canada.

    Purchased my 2014 Hyundai Tucson from the original owner in 2020. Have changed the oil faithfully every 4,000 miles but am having to return every 1,000 miles for an oil top off because itโ€™s burning through the oil so fast. Had a 100,000 mile service done last year and told my mechanic about the excessive oil consumption but he found no leak. The oil light fails to come on so Iโ€™ve driven the car at times with the oil bone dry without knowing. Iโ€™m now checking the oil religiously since the light fails to come on. I just got another oil top off a few days ago after being concerned about slow acceleration going up hills. I thought it was due to the oil being dry again and a top off would fix the issue. Yesterday the car acceleration began giving out on the highway once I reached high speeds and was unable to climb hills above 40mph. I had to floor it to climb speeds. I dropped it off at the Hyundai dealer and am waiting for a diagnostic. Iโ€™m worried the engine has failed. Iโ€™d like to join this lawsuit.

      I have a 2017 Hyundai Santa Fe Sport that has been consuming alot of oil. I went to the Hyundai dealership and they wanted to do an oil consumption test but due to my SUV being out of warranty, I would need to pay $1,000 for the test. Currently my SUV is at 110,000 miles and as I was driving it, the engine light came on and I was not able to drive over 60 miles per hour. I pulled off the freeway to check the oil and it was low but it stalled every time I was at a stop light or stop sign. Currently, my SUV is at a shop and the mechanic informed me that due to the oil leak it melted my spark plugs and also the engine combustion and 0 compression on 1 and 30% compression on 3. I just got off the phone with Hyundai Corporarion and they basically hung up the call because I kept asking to speak to someone who can help me and not read a script. Have they no integrity?
      I definitely want to join this lawsuit!

    I have a 2015 veloster that has high oil consumption for two years. Started oil study at dealership and mfg said only 1 1/2 qts low out of 4 quarts! And refused to do anything!!!!help!!!!

    I have a 2016 Hyundai Elantra GT Limited hatchback and and have had the past 2 oil changes both way low of what it should be. Then, this week after only having 2k miles on my last oil change it broke down on us. We had to tow it 2 hours away and get a rental car, just to find out the oil was completely gone. We live in Indiana and weโ€™re stranded in Tennessee for almost 24 hours. Hyundai has refused to do anything to help and continue to state to us, โ€œuntil it throws a code thereโ€™s nothing we can do. We suggest you drive it until it goes out on you or throws a rodโ€. This is totally ludicrous and irresponsible of the company.

    2016 Sonata burns oil at up to 10 quarts between oil changes. Started happening around 89,000 miles on the odometer.

    My Hyundai Sonata 2013 have an oil consumption problem. My car was checked every 1000 at the dealer to prove them it is a real problem. Then the dealer ask me to leave car overnight so they can do a specialized oil consumption test. Next day was told Hyundai declined to cover the test due to car have more than 100k miles even I have a lifetime warranty on the engine from a previous recall . Called the main company office and was told to start a complain process thru BBB auto. After a mo if Hyundai do not agree to fix the problem the BBB auto will start an arbitration process. More than 3 mo passed and no news.
