Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automakerโ€™s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasnโ€™t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the ownerโ€™s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldnโ€™t be, damaging the combustion and exhaust systems.

This allegedly causes โ€œabnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.โ€

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customersโ€™ warranty claims even when the warranties have expired.ย 

According to the lawsuit, Hyundai canโ€™t adequately repair the oil consumption problems and doesnโ€™t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, โ€œand in most cases do not receive required engine replacements.โ€

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011โ€“2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles.ย 

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

    I have a 2017 Tuscon Night. Engine blew while under warranty. Took Hyundai months to get it approved under warranty and another 6 months to replace it among other things, all under warranty. I have had my car back for 3 weeks and now it doesnโ€™t want to run m, fumes coming out, loud noises. After they had my vehicle for 8 months! I had no car for the first 3 months, no way to get to work. They provided a rental car for the remainder but I had to pay out of pocket $1200 for a rental in the first month. Please contact me. I want to know my options. The car just started breaking down this morning.

    Good morning. I have a 2019 Hyundai Santa Fe that has less than 40,000 miles on it and still under warranty. My engine seized with no Lights warning of any concerns. My husband contacted Hyundai and they informed him that they would not accept the car at this time due to supply chain issues. As a result, We were forced to seek another mechanic and replace the engine out of pocket even though my car was still warranty. We had previously brought to Hyundaiโ€™s attention that my carโ€™s radio would turn on and off and that we thought there were electronic issues. They examined the car and could not find anything and so they dismissed us. The electronic issues continued. The car seized on May 25th with my 16 year old son (who is a new driver) on a heavily trafficked highway. Fortunately there was no accident or injuries, however, this was extremely stressful to a new driver and us parents. This all could have been prevented if Hyundai had provided accurate maintenance. Since the incident, I have reached out to Hyundai numerous times. They have yet to return any of my calls. I am know seeing that other owners have had similar unfortunate issues with their Hyundai vehicles. Can you please advise me.

    My 2015 Sonata which I purchased last year had to have an oil change yesterday after 3,000 miles. The oil was very low! The dealer told me that Sonataโ€™s were having a problem with burning oil and I needed to check it frequently. Engine problems are not worth fixing so no more Sonataโ€™s or Hyundais for me. In the meantime, do I have any options for this problem while I keep this car?

    On Saturday Jun 4, 2022 my daughter was driving her 2017 Hyundia, Sonata and her car start making noise and jerking. She call and asked what to do. Since the Hyundia dealer was closed I asked her to drive it home if she could and take it to Pep Boys on Sunday Jun 5, 2022. Pep Boys discovered there was no oil in the oil pan. They put the car on a lift and found no leaks under the car. She had the oil changed at the Hyundia Dealer on May 9, 2022 at 77,765 miles. On June 5, 2022 Pep Boys added 4.5 quarts to fill at 78,845 miles and we paid for this service. Pep Boys told her not to drive the vehicle because it may have other problems. Monday Jun 6, 2022 we had the vehicle towed from Pep Boys to the Hyundia dealer. I spoke with the service advisor and he said the 2.4L engine was having a problem with oil consumption. He told me that they would run a rod bearing clearance test and if it passed they would search for updates and may have to replace the knock sensor for $500. if it failed they would replace the engine at their cost. The vehicle was returned on Jun 7, 2022 and receipt stated the ECU had not had the knock sensor update. Upgraded ECU cleared code and test drove.

    We had to rent a car so our daughter could have transportation to work. They told us it was not their fault and would not provide a loaner vehicle for us to use. The service department was adamant about taking any responsibility knowing they have problems with this 2.4L engine. That is the reason I want to join this Class Action Suit. I do not believe it is right for me to incur expenses/cost and safety issues for their defective engine.

    i have had 2 engine failures since buying my 2016 elantra gt, apparently there was already a lawsuit i missed. So im still paying off my car, its been sitting in the driveway for a year and a half, the engine is no longer being manufactured and i cannot find any replacement engines. How can i sue to get all my money back? smh
