Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automaker’s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasn’t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the owner’s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldn’t be, damaging the combustion and exhaust systems.

This allegedly causes “abnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.”

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customers’ warranty claims even when the warranties have expired. 

According to the lawsuit, Hyundai can’t adequately repair the oil consumption problems and doesn’t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, “and in most cases do not receive required engine replacements.”

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011–2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles. 

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

    I have a 2016 sonata sport that the engine seized up on after doing oil consumption test. I talked to Hyundai motor America to which they no longer return or answer my calls. I haven’t driven my car since November 2021 and nothing has been done through Hyundai.

      Owner of a 2014 Hyundai Tuscon with a “Nu” engine that had catastrophic engine failure at 94k miles due to metal shavings-Hyundai would not replace engine because It was not the Theta 2. Hyundai KNEW about these problems with all engines but REFUSED to take responsibility-it took a Hyundai engineerswhistle blower to expose the truth

    This is terrible my 2016 Hyundai Tucson is also burning oil. Can’t believe Hyundai was allowed to sell these cars with engine issue for so long. Add me to the lawsuit. I’m a single mom with a kid in college, I don’t have money to put into a new car. Will never buy a Hyundai again.

    I am currently affected by this. My 2017 hyundai sonata goes through a full oil change in 500 miles. They were doing an oil consumption reading but apparently since i am out of warranty I have to start over and do this all over again, starting today. I have to pay for 4 oil changes then I have to pay for a combustion chamber cleaning which is $700. I really need to join this class action! HELP!

    How do I join the Hyundai Class action Lawsuit? I have a 2015 Hyundai Santa Fe and I have had the same oil consumption. I was checking oil every couple of days. Then 2 days ago, May 18th, my engine froze or seized up. There was no oil in it??

      I would like to know how to join too. I have a 2014 Hyundai Sante Fe and the oil consumption is just getting worse. I didn’t see that 2014s were included so want to make sure I can get on it as well so hopefully can get reimbursed for a new engine. I only have just over 100,000 miles on the vehicle.

    My car is in shop for oil level issue right now. 2 times in shop for the knock sensor and as we know that was engine related… Adding oil inbetween oil changes is absurd for a 2017 vehicle. I hate this car!

    I have a 2015 Hyundai Santa Fe which I bought new and only have 46500 miles and I am having the same issue with the oil. I took it to the dealership, performed the oil consumption test only to have Hyundai tell me that they were denying the claim due to “improper maintenance” on my vehicle. Also, I drove my vehicle to the dealership with no sounds, no hesitation but some how I now have a blown motor, Wasn’t blown when I drove it to the dealership! I’ve tried to contact an attorney but no one will get back to me. HELP!!!

    2014 Sonata acquired in October of 2021. Stalled twice before the oil light and check engine lights came in then completely quit while I was driving with my two small children. I was terrified! Thank God I didn’t cause an accident. The car has been sitting for three weeks now. I’m not sure what to do!! I have no money to throw into this car and have been following closely in regards to all these recalls. I desperately need a car! Please help us

      I also had a 2013 Kia Optima with the same damn engine back in 2018. I’m disgusted. It was repossessed because the dealer wouldn’t honor their service contact and I couldn’t afford it I pocket expenses! They f’d me in the whole deal and when I called and emailed to resolve the issue I got nothing. I ended up filling a report and the whole account was cleared off my credit report?!! Two months later the place vanished!! Now what?

    My sisters 2014 Santa Fe sport 2.0L , Engine was burning through oil for the last year. As a result the engine failed. She still owes 11k and the engine is 13k to fix. Please add her to the list.

    Had to get my car towed to the dealership due to not having any oil at all. From the sound of it I will be out of a vehicle for a while and I am not getting a Courtesy car or able to get a rental due to shortage.
    I’m stressing out on how I will be getting to work.
