  • Court approval of the dismissal was not required as the class had not been certified nor proposed to be certified for purposes of a settlement, according to court documents.

Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automaker’s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasn’t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the owner’s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldn’t be, damaging the combustion and exhaust systems.

This allegedly causes “abnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.”

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customers’ warranty claims even when the warranties have expired. 

According to the lawsuit, Hyundai can’t adequately repair the oil consumption problems and doesn’t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, “and in most cases do not receive required engine replacements.”

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011–2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles. 

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

    My 2013 Santa Fe sport has been oil for years. I did an oil consumption test at the dealership and it burns 8.28 quarts every 3k miles. They said I need a new engine. My catalytic converter is shot now because of the oil burning. I can’t pass smog to register my car…however, it just died so I’m now without a car.

    I bought a 2017 Hyundai Sonata sport 4-10-21. I’ve had regular maintenance and oil changes on it. The car ran out of oil once a month in November December and January. I had an oil change January 10,2021 but January 24 it ran completely out of oil. Each time I put 5 quarts in. On February 7 I was driving on the highway 31 miles away from home and the engine locked up. Alexandria Hyundai had my car since Feb 8th. They’ve been slow at handling my case and I haven’t been able to get a loaner car. Been paying thousands for a rental car since Feb 8.

    I have 2016 Accent that also I need to check and add oil frequently. At oil change I was always get over a quart less than what was put into vehicle. I just had to get engine replace because of miss fires from damage.

    Why was the Accent not part of law suit for oil issue.

    I’m just now seeing this. I have a 2014 Hyundai Azera, and the engine has completely failed. No warning, no problems. It went from perfectly fine to dead in one day. I do not see the Azera on the list of faulty engines. The Hyundai dealership will not help me either, and want over $13,000.00 for a new engine. What can I do?

      My car has been burning oil for a while. Hyundai replaced engine after 6 oil consumption test. I just don’t trust that car will be okay since it’s not a brand new motor. How can I get added to this class lawsuit

    I have a 2013 Santa Fe that has been rendered inoperable due to metal in my oil. Hyundai refuses to replace the engine under warranty. My vehichle has 89,000 miles. ADD MY VEHICLE.

      My husband has a 2013 Santa Fe sport and it’s starting to give us trouble too 😓 I drive a 2017 Santa Fe and have been parking it outside for 2 months now because of the news of the engine fires… but so far NO RECALL OR EVEN notice of when there may be a fix. I have 2 small children and am worried. Wish I could give it back 😓

    2016 Sonata hybrid. HMA denied to pay services 3 times under warranty when my car failed. (Recall 198) Even when you can prove proper maintenance. They will always find another excuse to not honor warranty. When the engine fails then most likely will cause the hybrid system to fail and adds more costly burden to owner .

    2018 Tucson 2.0L brand new off lot and notice oil consumption 1 quart every 1000k miles since bought it. Take notice to dealer under warranty status and been told nothing they can do with it and it normal per dealer. I will never ever buy this brand name.
