Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automaker’s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasn’t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the owner’s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldn’t be, damaging the combustion and exhaust systems.

This allegedly causes “abnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.”

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customers’ warranty claims even when the warranties have expired. 

According to the lawsuit, Hyundai can’t adequately repair the oil consumption problems and doesn’t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, “and in most cases do not receive required engine replacements.”

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011–2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles. 

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

    I have 2016 Hyundai Tuscon motor went out before warranty had all correct oil changes no sensor went off for low oil at all car just died! Got another motor under warranty have been super cautious make sure my oil changer have been on time 2000 miles over warranty motor went out again, this motor only has 50 thousand miles!!! Not a low oil sensor, nothing went off!!! Basically now I’m screwed!

    I have been experiencing the same issue with my Hyundai Sonata 2016. Specifically, I have been encountering a persistent problem with the engine oil running low despite taking measures to address it.

    To resolve the issue, I recently replaced the entire oil pan to eliminate the possibility of any leakage. However, the problem has persisted, indicating that there may be another underlying cause. Based on my observations, I suspect that the engine itself is burning the engine oil. Upon seeking professional advice from car shops, I was informed that this is a common problem with Hyundai vehicles.

    I bought a 2016 Hyundai Santa Fe limited in 2021. I’ve had the of changed as recommended. On 5/16/23, I was driving on the highway at about 60 mph. I had my granddaughter with me and suddenly, the vehicle shut down. Every warning light was lit and I had no control over the vehicle. Thankfully, I was able to drift off the road. Prior to this, I had never had any warning light come on. Had the vehicle towed to a hyundai dealer and was just notified the engine had seized. I think it has 108,000 miles.

    I brought a Hyundai Tucson 2018 model last year with 29k on the clock. We’ve only done 6k miles up to now and we’ve experienced 2 low oil lights on long journeys. The 2nd time it happened it was with just my wife and our 18 month year old son in the car so this is appalling for a car with low mileage!! I was unaware of the faulty engine issue until this second time as just thought the first time was by chance.

    I bought a 2018 Sonata Sport with 64,000 mi. within a few weeks engine cut out. Hyundai kept it 3 mos, said it needed a computer update. Said the engine was ok. I have driven it 2.000 mi and light came on and it was totally out of oil. They told me to add oil every 200 mi. if needed. now, they are making me do an oil consumption test, but no promise to do anything to fix it. What can i do now?

      I’ve been battling Hyundai with my 2018 Hyundai Tucson Sport. I’ve completed my oil consumption tests a d failed everyone that’s been done with 2 quarts or more low at 1000 mile checks. Upon completion last week I was told to drop it off, pick up a rental vehicle covered by warranty and a new enchine would be put in as the warranty coverage was covering. This was told to me on 6/9/2023, today 6/12/2023 I received a phone call stating to return my rental and pick up my vehicle that now it has to go through another oil consumption test with them. I honestly think they are trying to run out my warranty and also my extended warranty coverage being my Tucson has 86000 miles. Please contact me as I’m going through this exactly with my vehicle and Hyundai.

        Same thing happened to me did two consumption test an. Top clean I was still burning oil so when Sen to corporate to repair they said it’s not burning enough oil but the dealership showed it’s burning on. 2019 sonata 1 owner I am angry they sold me. Lemon and don’t want to repair their issue

    i have 4 oil change within 2 month my emgine is stalling. i cant get appointments until july 19 so that mean my warranty will expire They need recall this asap

    I bought a Hyundai sonata with 115k miles a few months ago and i started noticing that it consumes a lot of oil i thought that it was something else but now i see that I’m not the only one who has the problem. How can I join the lawsuit?

    I’m the original owner of 2017 Hyundai Tucson SE Plus Sport Utility. My engine light came on. I took the car into the dealership. They told me there was no oil in the motor and the knocker sensor needed replaced at my cost. I just got and oil change 1000 miles before.
    The knocker sensor cost me $400.00. They put me the the oil consumption testing. While doing the oil consumption testing. I needed a new catalytic converter. The rpms kept ramping up for no reason. Then I lost power. I had to put on my 4 way flashers just to go up a hill. They gave me a new catalytic converter. They also sealed my motor and told me I was good. My vehicle is waiting to go in to Kerry Hyundai on this Wednesday. I have stopped in there dealership twice last week. I have hit the 1000 mile to see if we are going to start the warranty trial again. Which I’m sure this is what they are going to do for me again. The rpms are reving up again in the last 2 days.
    While I was talking with the manager last week he told me one customer has went through 4 oil consumption trials.
    HELP
