  • Court approval of the dismissal was not required as the class had not been certified nor proposed to be certified for purposes of a settlement, according to court documents.

Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automaker’s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasn’t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the owner’s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldn’t be, damaging the combustion and exhaust systems.

This allegedly causes “abnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.”

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customers’ warranty claims even when the warranties have expired. 

According to the lawsuit, Hyundai can’t adequately repair the oil consumption problems and doesn’t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, “and in most cases do not receive required engine replacements.”

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011–2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles. 

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

    I have a 2016 Hyundai Tucson, the engine has been burning oil for over 6 months now. I’ve had TWO DEALERSHIPS GHOST ME over this issue, even AFTER one did the oil consumption test. After two months I finally got ahold of someone who told me they have been trying to find an engine….then referred me to another Hyundai Dealer who of course is not returning my calls. This is incredibly unsafe, Hyundai you should be ashamed!

    Wife has a 2017 Kia Soul and it uses a qt of oil every 380 miles, like clock work. The dealer says that is normal. If they think that is normal then they know absolutely nothing about working on a car. What is there plan, to hope it goes away? My lawn mower doesn’t use that much oil.

    I just had my engine replaced on in Dec 2022 on my 2016 Hyundai Tucson because the engine blew up. The mechanic told me that these engines burn a lot of oil. I’ve never been told these! How do I join this class action?

    2017 hyundai santa fe
    Started consuming massive amounts of oil around 60k miles. Contacted Hyundai they told me to ” Just keep oil in it”. Now at 100k miles I’ve paid nearly 4k in repairs known to be caused by oil consumption. I had to have all the valves replaced. Convenient enough they said I have a cracked pan that wad also replaced. Tipped it off less than a week ago, you guessed it, It needs oil again. I will never buy another Hyundai. Most recently every light came on and it completely stalled out ON THE FOURLANE! THEY ARE LITERAL DEATH TRAPS

    WA state. My 2016 awd Hyundai Tucson cost me dearly. Over 11k in repairs, none which Hyundai paid for. All due to oil consumption issues. 2 cataleptic converters, bottom end of motor replaced, exhaust system, the list goes on. I couldn’t even drive 3000 miles after an oil change and still have oil showing on the stick. I notified Hyundai, and guess what….they could care less.

    My 2020 Hyundai Palisade is suffering from high oil consumption. I’m sure Hyundai knows all about it but they continue to act “surprised” that this is happening. They are dragging this whole investigation out because I’m sure they can’t replace all these defective engines at once. So frustrating

    I bought a 2017 Hyundai Sonata Sport for my college student about 14 mths ago. Right about 80k mileage mark during and oil change it was noticed that the oil level was very low. We’ve been checking and putting oil in the car ever since (5 mths now). She really like her sport and I thought I made a purchase that she could at least drive for at least 4 years. Very disappointed

    2017 hyundai sonata everytime I have the oil changed they tell me.its low and I should have a oil.consunprtuon test so I did I went to a hyundai dealer got my oil.changed and started the test took it back after 1,000 miles it was down 2 1/2 quarts was given a appointment to come in Oxford combustion cleaning dropped my car off for that went and picked it uo the worker informed me everything I did was for nothing because his office didn’t handle it correctly and they would need to submit things to hyundai before they could go any further I forced him to give me the paperwork for my car from today which on the paper it states my car is using 1 quart every 650 miles! Per hyundai I should only be using 1 query every 1,000 miles! Something needs done! Now they tell me.if hyundai don’t approve it I will have to pay out of pocket for the oil consumption BUT THEY ALREADY DID A OIL CONSUMPTION test!! These people need sued and I will be looking in to it further because I refuse to keep driving this car and them tell me oh to many miles now it’s not covered!
