  • The class action lawsuit claimed a number of Hyundai and Kia model vehicles contained an engine defect that caused them to use an excessive amount of oil.
  • The vehicle owners argued the alleged defect, in addition to costing them money for the excess oil, caused the vehicles to stall and eventually fail. 
  • Court approval of the dismissal was not required as the class had not been certified nor proposed to be certified for purposes of a settlement, according to court documents.

Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automaker’s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasn’t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the owner’s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldn’t be, damaging the combustion and exhaust systems.

This allegedly causes “abnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.”

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customers’ warranty claims even when the warranties have expired. 

According to the lawsuit, Hyundai can’t adequately repair the oil consumption problems and doesn’t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, “and in most cases do not receive required engine replacements.”

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011–2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles. 

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

    I literally just checked the oil after reading this and it was 4 quarts low. I will say that it’s about time 4-5K mark for another oil change but haven’t ever looked at it. It’s not an old car and figured it was fine.

    I currently own a 2016 Hyundai Sonata that was a headache when it hit about a year after purchase. I took it several times to the dealership to be looked at because it was drinking oil, and the transmission kicked like a mule. Each time they said that they couldn’t get the car to recreate what I saw. About 6 months ago I gained a new lawn ornament due to catastrophic engine failure. It had drank 5 quarts of oil while my daughter went to school and work. When she was on the way home it died.

    my 2017 hyundai sonata is burning oil bad. i do the oil changes when need to but by the time i hit 1500 miles after i change it the oil light comes on and my car acts up and my oil gets really low. i add oil till its my next oil change. right now my car isnt acceralting the way it should its like its gonna cut off.

    My 2015 Kia Soul was an excellent car until August 2021 when the Catalytic Converter failed. $2700 to replace at Pep Boys but I was in Houston five hours from home after a great road trip from the Rio Grande to St Paul to Chicago to Ohio to Tennesee to Houston… It has since been a nightmare. I carry a jug of oil and check the oil daily. Then Catalytic Converter failed again. $700 at local mechanic. Constant complaints for over a year with Paul at Bert Ogden Kia in Harlingen, where he advised me to quit putting oil in it and let it fail! Last time I went to complain (I’ve used up all my AAA free tows, and have paid for two more!) Paul had quit just after he advised a THIRD Catalytic Converter AND a MUFFLER! Um, no. Mechanic said it had fouled plugs, and it drove pretty good for awhile and now whole car is shaking violently, I had to drive two-footed just to barely make it to the dealership! New guy Matt seemed nice at first, but seems like more. of. the. same. song. and. dance. He advised Catalytic Converter and replacement plugs! When I told him I’d done both already, he ummed his way into nothingness per the new usual. Friday he left a message on my phone, but when I went in he had “called in sick for a week!” This car is selling for $17,000 now, used! I hate to buy a new car now with very inflated prices everywhere on both used and new cars, and rising interest rates! This car is just too dangerous to drive! Twice it died while I was in the Expressway fast lane going 75mph! Help! I’ve gone 64 years without using a lawyer, and I’m not sure it would do any good anyway! I know nothing about the legal system but I think I’m about to find out! Oh! And no loaner cars! Matt’s had the car for a MONTH! I’m driving a 1999 Astro Van (23 years old and driving fine so far!) to work and back, and the spouse is driving a 1989 Buick Century that has been in the family for 33 years! AND THIS KIA SOUL IS DEAD AT SIX YEARS OLD?!!

    2014 sonata now warning light came on to notify me that I had 0% oil in my vehicle. Ever since software update no warning lights come on. 3 months later engine is overheating and still no warning light came on. I also hear my brakes rubbing but again no warning light comes on. Taking it to dealer. It has 86,000 miles.

      At least you had the warning light. I have a 2015 Sonata and no warning light. Dealer said car wasn’t equipped with this feature. Dumb luck that I checked and had almost 0 oil in the car. Took 4.5 gallons that day and has been a nightmare since.

    Having the same issue with my 2017 Hyundai Santa Fe sport.
    So here is a question, how do we get this oil consumption issue fixed by Hyundai, I am constantly dumping oil in and can’t have anything happen to my engine because a day went by that I didn’t check and it was empty.
    Help
