Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automaker’s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasn’t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the owner’s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldn’t be, damaging the combustion and exhaust systems.

This allegedly causes “abnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.”

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customers’ warranty claims even when the warranties have expired. 

According to the lawsuit, Hyundai can’t adequately repair the oil consumption problems and doesn’t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, “and in most cases do not receive required engine replacements.”

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011–2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles. 

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

    We have a 2017 kia sorento. And I just took it to csrmax today for oil light flickering oil leakage. They said i didn’t have a leak and want to do an oil consumption test. I’m due for an oil change and they said not to change it I need to drive 1000 miles and bring it back. My car is not wanting to start and I’m sure it’s due to oil being in my alternator which I can see with my eyes…. but they said there’s no leak…. I’m concerned and worried that my engine is about to go. And they will not replace it. I’ve read numerous articles, even seen the docets for this law suit and they all under went a oil consumption test to be told they is nothing wrong. I’m assuming I’m going down the same path too.

      We own a 2014 Hyundai Accent Hatchback. We have experienced the car burning excessive oil between oil changes. I am not sure if this warrants eligibility in this law suit. Please contact me to let me know. Thank you.

      I own a 2019 Hyundai Tucson. Last 3 oil changes very little oil left. Engine light on and off between oil changes. Diagnostic at dealership at about 70k indicated camshaft position censor slow. Now 2 oil changes later same issues and catalytic converter shot. Service department did not reveal anything about known issues but gave me cost to replace the sensor and convert. Didn’t reveal faulty engine with excessive oil burning which would have cause failure of the camshaft sensor and catalytic converter. Just so happens the catalytic convert not under warranty after 80k. Thankfully I have the 70k diagnostic report of a faulty sensor caused by low oil. Time to put the gloves on.

        My 2019 Tucson sounds exactly the same. Just recently had to install new knock sensor because it went in limp mode. Also hesitates badly to accelerate. And check engine light code of 0420 comes on and off. I hope I hear something from this. I only have 65k on vehicle.

    I have a 2015 Hyundai Santa Fe that is consuming an excessive amount of oil. Every 600 miles I have to add 4-5 quarts of oil. if possible I would like more information about the class action lawsuit against Hyundai?

      I have a 2014 Hyundai sonata and I burn oil excessively. I’ve checked for leaks and I don’t see any. I just put 4 quarts in and I’m not even due for an oil change, the red oil light just turned on. This happens at least once between oil changes even when I get them done regularly. It’s costly and I’m nervous there’s more damage from constantly running low on oil.

        Same car, gdi crap… Same exact oil consumption. My mechanic says he’s got 3 sitting at the shop all with the same problem… Piston rings/cylinder distortion. I’ve switched to 5w-30 as opposed to 5w-20 it has slowed the consumption but still burns a lot. Take it as a life lesson on buying cheap asian junk, that’s what I’m doing. Yeah it sucks, spread the word about Hyundai to everyone who will listen hopefully all of us can put these criminals out of business… Mine started at 99k with the oil burning and has like 17 recalls lol

    I don’t believe my 2015 Tucson should’ve ever been sold to me. I just put 10k in a “guaranteed” engine rebuild from the dealer and my car is doing the same thing. Now it’s leaking oil on my spark plugs & I’ll be getting my 3rd catalytic converter.. what can we do?

      My 2017 hyundai sonata has gone through 6 quats of oil in the last month. Talk about excessive oil Consumption. There is no burning no leaks. Where is it going?

      Have 2017 Hyundai Sonata and I don’t really drive much during the week. My last oil change was in April and I’m still 1900 miles shy of needing a new one but my oild light flickered on and off a couple times the last few days. When I checked it, it was dry. There’s definitely a problem

    2017 Santa Fe sport, had to be towed due to engine issues back 2021 and since then have to keep lots of oil in my trunk because it runs low so fast and now having transmission issues. Wont fix anything until i do the oil and combustion consumption test and to complete them both I have to put 2,000 more mile on my car before i kno if they will even fix it. Plus making pay to replace parts that only need replace bc of this issue. I just want to sell it but then thats want they want to frustrate you until give up and get a different car
