  • Court approval of the dismissal was not required as the class had not been certified nor proposed to be certified for purposes of a settlement, according to court documents.

Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automaker’s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasn’t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the owner’s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldn’t be, damaging the combustion and exhaust systems.

This allegedly causes “abnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.”

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customers’ warranty claims even when the warranties have expired. 

According to the lawsuit, Hyundai can’t adequately repair the oil consumption problems and doesn’t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, “and in most cases do not receive required engine replacements.”

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011–2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles. 

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

    2017 Santa Fe Sport using 4 qts of oil every 3700 miles and getting worse.

    I’m also an owner of a 2013 Hyundai Sonata with excessive oil burning. I just found this website and it’s frustrating to hear that there is no help for us. I had my oil changed on 9/18/22 and then on 10/20/22, I was already down a quart and a half. So today I stop and get gas check my oil and yep down another quart since the 20th. I will continue to complain until they get it fix, I’m part of the extended limited lifetime warranty on the engine as it is, not to mention the fuel hose recall that can’t be fixed until Dec. 2, 2022 is the soonest they can repair the recall.

    This is happening to me. First they blamed the place that I was getting oil changed, this cost us $600. Now I’ve taken the vehicle every 1000 miles for consumption it is always 2 quarts low. Somehow this last time (the time that they said took me to the next phase.) I wasn’t low enough only a quart. So they say bring it back again in 1000 miles. I have done this 6 times. Originally I was told I would need to do 4. My husband and I are at our whits end and don’t know what to do. Does anyone have advice??

    Just bought my 2017 Santa Fe… it’s burning 2 quarts every 5-700 miles. I’ve had the car 2 months!!!! Completely frustrated. Not fair. Hyundai doesn’t help.

      I have a 2017 Sonota with 93,000 on it now. We bought new and every 800 to 900 miles we have to add 2 quarts. This is a very poor engine

    Oh my gosh, my engine was going out in my 2013 hyundai tucson. I traded it in because of that. I’m screwed. My sister’s went out in her 2011 accent, my neighbors went out in her 2017 elantra. And my other neighbors grandsons went out in his 2019 hyundai elantra. We all got screwed!

    My 2019 Hyundai elantra had recalls on it n engine blew out 10/2021 my car sat at the dealership until February with no diagnostic or anything. It got repoed and finance company put a lien on my mom’s home because she cosigned so im paying for a car that I dont have and was under warranty still. Due to our family finding out in February 2021 that my little sister has cancer I focused on her and let the car go and now im losing everything I worked for because no transportation.

    My 2019 Hyundai elantra broke down in October of 2021. I had the worst time getting help from the manufacturer. After taking it to the stockton dealership it sat there for the first month with no diagnostic or nothing due to the fact that they lost the keys. I live in stockton and worked in Dublin ca. December passed no rental or loaner at all. January came and no diagnostic still when I got the bbb and consumer affairs to investigate the finance company repoed the vehicle for non payment. My car was under warranty still and on the lot for over 3 months with a blown engine and absolutely no diagnostics. Undriveable and with no communication from the dealership or the manufacturing company I lost my car. My little sister was diagnosed with cancer February 2021 and I put all my energy and focus on her. Im now still paying for a car I dont have because my mom cosigned and the finance company put a lien on my parents home. Im losing everything I have because I can’t make it to work. Hyundai is crooked and their customer service is the worst! I pray that they get shut down for selling faulty cars and putting families through such chaos.

      I am also the owner of a 2015 Hyundai Sonata which requires adding oil frequently due to excessive oil burning.
