  • The class action lawsuit claimed a number of Hyundai and Kia model vehicles contained an engine defect that caused them to use an excessive amount of oil.
  • The vehicle owners argued the alleged defect, in addition to costing them money for the excess oil, caused the vehicles to stall and eventually fail. 
  • Court approval of the dismissal was not required as the class had not been certified nor proposed to be certified for purposes of a settlement, according to court documents.

Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automaker’s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasn’t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the owner’s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldn’t be, damaging the combustion and exhaust systems.

This allegedly causes “abnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.”

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customers’ warranty claims even when the warranties have expired. 

According to the lawsuit, Hyundai can’t adequately repair the oil consumption problems and doesn’t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, “and in most cases do not receive required engine replacements.”

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011–2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles. 

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

    2021 Palisade Limited 42k miles… 1 qt per 1000 miles for Oil consumption. Did the consumption test and they determined that that is normal operating for there engines. There is never an oil indication of it being low and at around 3 quarts down the engine just stalls. They closed the case saying it is normal… not sure how this is concerned normal. There is no way this passes the EPA guidelines. Not sure what to do with this 50k paperweight. I have obtained the printout test that they have the dealers run for the oil of that helps. It is not scientific at all and can be beaten with just overfilling during the test. A dip stick is not a defined unit of measure.

    My 2016 Hyundai Sonata is burning oil at an alarming right. Two weeks after an oil change, my oil light comes on. I am adding additional oil every other week. I am now hearing a rattle in my engine. Mechanics are refusing to touch my car because of this known issue and those who are willing to are quoting me high prices and long wait times with no guarantee.

    My 2016 has been rattling under the hood and consuming 3.5 quarts of oil since 2020 and it only has 79,000 miles on it now. When it started and i kept asking the dealership to find out why it was doing that it only had about 40,000 miles on it. They won’t fix it without me paying for several fixes that they don’t even know if they will work. My car also accelerates by itself sometimes and they have no solution for that either.

    2016 Hyundai Sonata 3 quarts of oil every 1000 miles, every Sunday morning I have to add oil. I will tell you stopped buying expensive oil, high mileage nothing last longer

    Soy de PR. Sonata sport 2017. Todas las semana hay que echarle aceite. Por ende dano bobinas y lo último que hizo fue sacar la gasolina por el motor. Gasta tanto aceite que si no revisas te quedas sin carro. Pero igual o peor el uso de tanto aceite dano más piezas motor.

    My 2017 Sante Fe Sport is consuming oil. I bought it a little over a year ago from a dealership. It was consuming oil from the beginning. Just took me a while to figure it out. Will never buy another Hyundai!!

    2018 Tucson second time the engine has been replaced now this time I’m being charged over $4,000 it was supposed to be $2,000 with a Goodwill of them paying half of it but the total has now come to over four grand to receive the car back from the dealership after it’s taken close to a month to have the engine replaced this is one year after the same instance of the oil problem please update me if this does become a recall so I can get my money back somehow if that’s even possible

    I have a 2016 Hyundai Tuscon that is currently in the shop and warranty won’t cover the issue due to it being an oil issue. I am furious!!!!! I HAVE HAD MY CAR 2 MONTHS

    Excessive oil lead to a ROD OR BEARINGS CLANGING ENGINE. NOW DISABLED…DEALER SAID HYNDAI WON’T COMPENSATE..M
