  • A judge dismissed a class action lawsuit filed by a group of vehicle owners against Hyundai Motor Co. in a California federal court. 
  • The class action lawsuit claimed a number of Hyundai and Kia model vehicles contained an engine defect that caused them to use an excessive amount of oil.
  • The vehicle owners argued the alleged defect, in addition to costing them money for the excess oil, caused the vehicles to stall and eventually fail. 
  • Court approval of the dismissal was not required as the class had not been certified nor proposed to be certified for purposes of a settlement, according to court documents.

Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automaker’s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasn’t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the owner’s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldn’t be, damaging the combustion and exhaust systems.

This allegedly causes “abnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.”

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customers’ warranty claims even when the warranties have expired. 

According to the lawsuit, Hyundai can’t adequately repair the oil consumption problems and doesn’t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, “and in most cases do not receive required engine replacements.”

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011–2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles. 

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

    I have the same situation with my oil consumption in my 2017 Hyundai Sonata SE and went through the BBB and was denied. How can I sign up for this class action law suit. Also how can a dealership sell a car with a class action lawsuit. It shows that Carmax is doing the bare minimum and got caught. I am unfortunate to be going through this because nobody deserves to have to put there life on hold because the businesses are messing up on there end. Any other information as well would be greatly appreciated, Thank you.

    2017 Hyundai Santa Fe owner here. As like everyone else I am blowing through oil. While I keep checking it every week, I don’t believe I should have to. I probably would have been better off with my 2006 Honda accord with 200k+ miles on it. This is really concerning. I drive a lot for my job and im starting to worry. I bought the car with 38k miles on it and making payments. Please include me in on this as well.

    Original owner of a 2015 Sonata 2.0 Ultimate with 66,577 miles. Last week 9/9/22 my car stalled as I was pulling in my driveway. Zero symptoms what so ever zero warning and zero codes showed up and absolutely nothing to even suggest there is an issue when hooked to the diagnostic machine. So when looking under the hood we naturally checked the oil dipstick and was shocked to find that the oil level was extremely low. Considering in June 2022 I had the oil changed and I have not even drove 900 miles. Granted the car used a little more oil than any previous model of car I’ve ever owned but to have almost no oil and no signs of an oil leak in 13 weeks! And now my car work start and doesn’t even attempt to crank but all the fuses and relays as well as the battery are good!?!? So upset since the nearest Hyundai dealer is 120 miles away.

      I just experienced a similar thing today with my 2014 Sonata, I had my oil changed on 7/27. My engine sounded like it was rattling/knocking so I checked around and when I checked the oil level there was only a tiny drop on the bottom of the diptstick… so pretty much no oil!! No warning lights to indicate a problem either. No signs of oil leaks anywhere, oil was just gone.

    I am experiencing the same problem with my engine, and it costing me to keep adding engine oil less than a month. It reached a point that my vehicle is stalling now. I really needed help the sad part I still making payments every month. Kia Sportage 2018

    I have a 2017 Hyundai Sonata that burns a quart every 100 miles. Had it into the dealer many times, all they say at this point is that they would replace the engine when it starts knocking or locks up…. Not sure I trust this to happen.

      My 2016 Santa Fe Sport is doing the exact same thing. Crazy how much oil I have to put in every week or two since I drive so much.

    I’m experiencing the same problem ongoing for several months now . Have valve covers replaced adding oil every 1000 miles and now has become much bigger problem. I stay in top of all servicing and repairs no reason for a 2015 vehicle to be this problematic

      I’m having similar issue. My car is Hyundai sonata 2017, bought it brand new at a dealership. Then 2020 I started experiencing constant misfiring, even right now as I’m typing this comment, my car is at the dealership due to this problem. I’m frustrated at this I would like to join in this law suit.
