Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automakerโ€™s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasnโ€™t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the ownerโ€™s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldnโ€™t be, damaging the combustion and exhaust systems.

This allegedly causes โ€œabnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.โ€

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customersโ€™ warranty claims even when the warranties have expired.ย 

According to the lawsuit, Hyundai canโ€™t adequately repair the oil consumption problems and doesnโ€™t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, โ€œand in most cases do not receive required engine replacements.โ€

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011โ€“2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles.ย 

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

    I have a 2016 Hyundai Sonata sport and it has been using oil like crazy. I have to check it every week and have been adding oil to it constantly for quite a few months now. I just had my car in about a month ago at the dealership and they said I was leaking oil from my timing chain cover and valve cover. They said it was fixed. It did not fix the oil consumption problem. Please add me to the lawsuit.

    I have a 2018 Hyundai Sonata and itโ€™s burning oil way quicker than any other car i have owned and I had to put 3 quarts of oil into it even though i still had over 1,000 miles before it needed to be changed

    Please add me to this class action lawsuit. We purchased a 2016 Hyundai Tucson in June of 2022. We have replaced the oil seven times in a matter of the few months that we have on the vehicle and recently the engine burned through an entire 5 quarts of oil in a matter of 48 hours and the engine is now completely seized up and does not run. I still owe over $20,000 on this vehicle that we have owned for less than 6 months and is completely undriveable.

    I bought 2015 Sonata 1.6l Aug4,2022. Itโ€™s engine has consume 1q oil for a month. For 1 year, it will consume 12q. That is a lot. I hate it.

    Brought car in for the software recall 2 weeks ago. Other than always adding more oil way before my next change is due car has been fine. Was told that I also needed to replace gaskets as oil leaking around engine. Go figure. Left car overnight picked it up and on my 4 minute drive home, car had no accelerating power over 30 mph, safety warning lights on and when I would heโ€™s my foot off the break pedal bike almost catapulted me forward scared the crap out of me. Had to bring the car back so they can reset it one more time but now my friend noticed that my car is making oil onto her driveway so now I need to bring the car back on Monday hopefully. Add me too please.

    I have a Hyundai Tucson 2019 and itโ€™s been burning oil since I got to 50,000 miles. I have to check my oil every week and add more. Before I knew what was happening it wasnโ€™t even on the oil stick. I am taking it to be checked out but clearly they wonโ€™t do anything to fix the problem. I thought Hyundai was reliable.       Update: took mine in and got an oil consumption test. At 500miles my oil was low and they told me that was normal. So they are cleaning out my engine and putting new oil in BUT they are making me pay for the oil change. I hope this solves the issue but based on reading all of these I dont think it will. I pray this actually goes some where because this is horrible.

    My wifeโ€™s 2017 Hyundai Sonata has been having this same issue where we have to put oil in it often. Now after her last oil change the vehicle started having misfires and overheating issues and idling issues and now we are being told we need a new engine. Good thing we found this if they donโ€™t honor the warranty.

    100% happens to my 2016 Sonata. I did a full synthetic oil change back in May. My oil light started coming on recently, when I checked the stick there was barely any oil on it. I had to go out 2 quarts in until I could get it in for a full change.

    I have a 2018 Hyundai Tucson and this same thing just happened to my vehicle 2 days ago while driving to work. Knocking started under the hood. Went directly to Jiffy Lube and they found no oil leaks but the car was bone dry of oil. I take my car in for regular oil changes so I knew it was nothing I did. They put oil in it but the knocking continued when I left. I took the car directly to the dealership where it now sits. They called me yesterday and told me the problem is due to excessive oil burning. I was told it should be covered under the Powe train warranty. After reading this article and the comments, how do I become a part of this lawsuit should Hyundai not honor the warranty and make the needed repairs without cost to me? Please advise and thank you!
