Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automakerโ€™s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasnโ€™t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the ownerโ€™s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldnโ€™t be, damaging the combustion and exhaust systems.

This allegedly causes โ€œabnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.โ€

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customersโ€™ warranty claims even when the warranties have expired.ย 

According to the lawsuit, Hyundai canโ€™t adequately repair the oil consumption problems and doesnโ€™t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, โ€œand in most cases do not receive required engine replacements.โ€

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011โ€“2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles.ย 

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

    My wife has a 2017 Hyundai Santa Fe. While driving to work the other day, she experienced exactly the same thing as many other Hyundai owners. Her car lost power while in route and stalled on the roadside. No smoke, no engine light, no low oil sensor, NOTHING. Come to find out about this excessive oil consumption issue from a mechanic friend that same day. We even had plans to turn it in for service the following day. Needless to say it arrived at the dealership on a flatbed truck a day early. Now the dealership service department is telling us that it could be from lack of maintenance, which it is not. They are giving us a hard time about covering the 100k mile power train warranty, which is one of the main reasons we purchased the vehicle. We have taken the SUV in as needed for regular service maintenance. Her car has just over 80,000 miles and now we may need to replace the engine. Hyundai needs to stand behind their catchphrase โ€œQuality is our prideโ€โ€ฆ..(I call bullshit) and honor their warranty. PLEASE ADD ME TO YOUR CLASS ACTION SUIT!

    2015 Sonata uses about a quart a week and has been doing so since at least 60K miles. Currently has 90K miles on and itโ€™s very frustrating for me to see an engine use this much oil.

    I have a 2015 Sonata with excessive oil consumption I have to add 3 to 4 quarts of oil every 3 weeks. Also premature spark plug wear. I believe this os the 4 time replacing plugs in a 6 month period and was finally told the fix for this would be an engine replacement. I still owe 9,000 on my car and feeling pretty hopeless at this point.

    I have a 2015 Hyundai Sonata,
    I have to get at least 3 top offs as well as put excessive oil in my car. Check engine light comes on and off and my car acceleration is slow at times.

    I been participating in the oil consumption test since June 2022, when I heard my engine ticking, checked oil, and oil was not touching the dipstick.
    Using 1 qt per 800 miles. While at the dealership yesterday, Sept 8th, a customer overheard me talking with tech, and approached me after my conversation with tech, to inquire of my issue he overheard, he proceeded to tell me, he was traveling (from out of state) and his hyundai stalled out on him in route. Had no oil. Both of our vehicles have less than 100k miles.
    PLEASE ADD ME TO THE LAWSUIT LIST!
    BTWโ€ฆCHECK YOUR SERVICE invoices. From the onset of this, I pulled mine, and found
    that they had been adding an additive (MOA engine oil supplement) to mine since it had 70k miles on it. So, THEY KNEW it had a oil problem, but never mentioned a word to me. I dropped off for oil change, paid, picked up. No a word about adding an additive. Nothing. Like all was fine. In my opinion, THEY KNEW about the oil consumption issue, and tried to cover it up with this additive. I did not know they were adding this additive until I went back and reviewed my invoices!
    Hyundai needs to correct THEIR mistake.

    I have a 2014 Hyundai Accent that is burning oil way faster then it should.. I have no oil leaks anywhere but have to get top offs n also replace oil even before the date of the change is dueโ€ฆ This is costly and getting worse by the month

    My 2017 Tuscon beginning to burn oil at 44,000 miles. Dealer said it has to burn 1 quart every 1000 miles before they will replace engine. Dealer said they are replacing multiple engines each week. Concerned about catalytic converter damage. Iโ€™m very disappointed in Hyundai.

    2016 Hyundai Tuscon. Cylinder misfire, oil changes every 1.5-2k miles, engine stalling, excessive oil use. Iโ€™m a commuting college student and I canโ€™t trust my car to get me through a simple 30 mile round trip. The misfire and stalling are new but I go through oil like crazy. What can I do? Last time I went to the dealer they told me something was wrong and my engine was dry, tried to tell me I had a cracked oil pan even though Iโ€™ve never experienced/witnessed oil leaks, and charged me $2000 for it. I just want to be able to drive my car.

    Yes, My 2016 Hyundai Sonata uses a lot of oil but thereโ€™s no leak. Every oil change it is low and requires adding oil between changes.

    I own a 2016 Tucson. Noticed engine ticking, before next oil change due. Checked oil. Not even touching the stick. Took to dealership, they changed oil. I called cooperate, they contacted the dealership, and initiated oil consumption test. Using 1 qt of oil every 800 miles. Currently has 98k miles.
    CHECK YOUR PAST SERVICE RECEIPTS! Upon pulling and observing my receipts, I noticed they started putting an additive (MOA engine oil supplement) every oil change, back when there was only 70k miles on it! I did not realize this then, only after I pulled prior receipts. They NEVER ONCE expressed they were adding this, or why! THEY KNEW OF THE PROBLEM, AND WAS TRYING TO COVER IT UP! Even after confronted with it, they did not have an answer!
    The employees at my local dealership keep changing like the wind. I feel like Iโ€™m steadily spinning in circles with them.
    Just yesterday, was at dealership for 2nd oil consumption test, another customer overheard my conversation with tech, approached me, and explained he was in route traveling, hours from home, and engine quit. Had no oil in it! He too, said he had regular/consistant service on his vehicle.

    PLEASE ADD ME TO THE LAWSUIT LIST!!! They should NOT get away with this!
