Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automaker’s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasn’t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the owner’s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldn’t be, damaging the combustion and exhaust systems.

This allegedly causes “abnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.”

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customers’ warranty claims even when the warranties have expired. 

According to the lawsuit, Hyundai can’t adequately repair the oil consumption problems and doesn’t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, “and in most cases do not receive required engine replacements.”

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011–2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles. 

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

    2014 Sonata 1 -2 quarts of oil a week. Dealer says I need to spend 500.00 to have the system cleaned and it will solve all my problems. It started burning oil at 80,000 miles. They told me they could fix it under warranty if I blew it up.

    2016 Sonata Sport. Uses 1-2 Quarts a week. I have had 3 Oil consumption tests done. Also spent money to have the PCV Valve replaced as recommended to see if that solved the problem. Still using same amount of oil. I put about 500 miles on my car every week as I have a 45 mile commute to work twice a day. I have never noticed oil under the car, it just seems to use it. I have over $150,000 miles on it so they are telling me none of the warranties apply. They have it in the shop at the dealership today and are supposed to be calling Hyundai. If they don’t do something appropriate to remedy the issue, I want to join the class action lawsuit.

      I’m in similar situation, with same Sonata, but have not yet taken to Hyundai to find out if this qualifies for engine replacement. I drive about 500 miles per week also and noticed the oil consumption over the last year.

    I have a 2018 Tucson and I am putting quarter of oil a week. The oil is so black even after every 3,000 oil change. I just went through the Hyundai oil consumption test. It Burnt up oil before 700 miles, then they flushed the engine. Now it didn’t burn as fast, but still burning and still will have to add oil. They said I didn’t qualify for new engine. So now I will have to pay thousands of dollars to have my engine flush every so many thousands miles when It still burns oil…. WTH and I am still paying on my car. Never buy a Hyundai car they don’t even stand by they engines!! Please add me to the class action lawsuit!!

    I have a 2018 Santa Fe. 2.0t. It’s burning more oil then it should. Every time I go into the dealer ship to get any warranty work done it’s like pulling teeth. Always extra cost and thing that are not covered. Lucky I know what I’m talking about and fight it. But I can’t even imagine they hell they will put me through if the e I get fails

        I owned a 2018 elantra… the oil light would come on occasionally and I would put in oil..had my oil changed regularly one day the car checked and flanged and nothing..I had it towed into hyundai fall river mass .I was then told my engine had chards in it from no oil change and hyundai would not cover it .I was then in a situation..my husbanda a disabled vet I need a car for dr.etc..both in late 60a. We are now 70 and 72 .we dis not have much money ..at this point salesman walked over said my car couldn’t be fixed it would cost approximately 4500 with no guarantee it would hold out..but they had a few cars we could look at..they had on suv..and so we found someone to finance us..they put the plates from hyundai18 on ford and said they would transfer it over..to show up the following sat to pick up inspection coupon..When I drove in the sales person came out with new plates and proceeded to remove the plates from my hyundai..I said wait!! What are the new plates..We didntcwant to get your Hope’s up but Hyundai replaced your engine..So I said which car is actually mine? Both..Both!! I cant pay 600 per car!! Well you will have to repo one then..
        Needless to say The Hyundai18 was picked up 2 or 3 weeks later…And the finance company has called and harrassed me ever since for balance not recovered at auction for hyundai..I checked vin# and it never came up as faulty..or recalled yet..my car had the problem you speak of..I got screwed into another car and longer pymts.
        I brought this to a lawyer who said I had a case..then when I went back to him he spoke to dealer and everyone covered everyones back..lawyer said it would useless and I would get nowhere..

    2018 Hyndai Sante Fe Sport. 3/4 quart of oil needed every 1000 miles. I just finished the oil consumption tests at the dealer. I was told that it needs to be 1 quart added every 1000 miles. How do we know they didn’t add 1 quart and just document 3/4 quart? We are not allowed to watch the process. Also how is it normal for a car to need almost 3 quarts of oil during the 3 thousand miles that follows an oil change? It’s not. The dealer told my Hyndai isn’t replacing engines anymore because it cost too much. They also told me they are not topping off oil for free. It is up to me to pay for that. Anyone know a law firm that would take this on? This is a solid case and no one is telling us how to join the Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC lawsuit.

    I have a 2013 Hyundai Sonata that had the engine replaced at 48,000 miles. They claimed there were metal shavings in it from original manufacture.

    They replaced the engine with a brand new engine.

    I’m at 48,000 miles again and the same thing is happening. My local dealership claims they wont replace this engine.

    So now I fill my car with oil weekly and fear any time I have to accelerate quickly to get out of the way because when accelerating quickly my car chugs and feels like it’s going to stall.

    How do we join this lawsuit?
