Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automaker’s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasn’t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the owner’s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldn’t be, damaging the combustion and exhaust systems.

This allegedly causes “abnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.”

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customers’ warranty claims even when the warranties have expired. 

According to the lawsuit, Hyundai can’t adequately repair the oil consumption problems and doesn’t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, “and in most cases do not receive required engine replacements.”

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011–2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles. 

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

      We have a 2017 Hyundai Sante Fe that has been losing oil quickly for about a year. We have to replace the oil constantly ,mechanic says it’s oil blow by. Recently our check engine light on during vacation. We replaced a sensor costing over $500 but the light is on again and still losing oil. We are told we need a new catalytic converter and it looks like the oil blow by is damaging the converter and new a new engine as well. My husband and I would like to be added to the lawsuit.

    I’ve been through several oil consumption test, spent a thousand dollars on getting my engine cleaned and the exhaust cleaned. I cant even take my car on road trips. On top of that my AC is no longer working! The car is only 4 years old! Please put me in on this lawsuit!!!!!

    2017 elantra oil sludge throughout engine stalling n engine light on.I’ve done oil changes w synethic n oil treatments .Hyundai blaming me saying not enough oil changes.Very shady I took car in for brake booster recall n to diagnosis engine light bc it wouldn’t ready for inspection 2 yrs in a row.I looked at paperwork from 2020 when they did recall n there’s an oil flush n oil control valve listed that I didn’t approve n was not told was done. N not charged for Seems odd that all they needed to do was run drive cycle n disconnect battery to ready my car.The oil flush n ocd have nothing to do with the brake tester replacement recall or the issue of the engine light I think Hyundai knew there was a problem I think they’ve known all along because there are other class action lawsuits and other issues with other Hyundai years in models and they’re trying to cover it up and I think doing an oil flush and replacing the oil control valve was a Band-Aid fix and the fact that they didn’t tell me about any of it really is shady they quoted me $12,000 for a new engine and a new catalytic converter I have been five months without being able to drive my car the air-conditioning doesn’t work it’s stalls out at red lights and stop signs it’s too dangerous to drive it on the highway to try and get over 60 miles an hour to see if the engine light will go off for going through the proper drive cycles the one year I’ve had to drive my car 1000 miles past the inspection due date to get the car to ready but when I took it to the dealership they had it done in 15 minutes I think what they did is they just cleared the code and didn’t bother taking it out on a test drive and did the oil flush and replace the oil control valve I’m trying to collect all of my paper work for all of my repairs unfortunately I can’t obtain the ones from the first year I owned a car because my mechanic went out of business but I take my car to Pep Boys since that time and they told me it’s a warranty issue with Hyundai and they’ve seen it with many holidays unfortunately hyundai will not do anything about it they said I could try and get a goodwill warranty claim after I give them all of my paperwork proving that I had enough oil changes my car is only worth $10-$11,000 and they want me to pay $12,000 for a new engine and a new tech converter I asked about a used engine the price was only $200 difference than a brand new engineThis is the third one day I’ve had in my family my first one went to 145,000 miles and had almost no problems except regular maintenance my daughter bought a Tucson two years ago I told her trade in and get rid of it because I wouldn’t buy another Hyundai and I would never recommend them to anybody

    I have a 2017 hyundai tucson. I also have this issue. I have performed two oil consumption tests and an engine cleaning. I’ve spent 11 months going through this process and paid the engine cleaning myself. Hyundai is seemingly delaying this process further by rejecting the report the dealership submitted this past spring/summer. Ther claim the dealership followed an incorrect process.

    Headaches, inconveniences, time sink, delays, misinformation and now then car has >100k miles on it so outside of warranty. I started this whole process at 80k miles, and it’s taken this long. Hyundai motor america won’t even have a conversation with me over the phone…. they keep emailing me without acknowledging what my complaints are and won’t tell me why my report was rejected. They are acting very shady. I’ve requested a phone call and they ignore/refuse the request. Corvin is my case managers name, and he just threatened me saying they’ll reject my opportunity to take A THIRD oil consumption test. Just to reject my report again? And waste my time?
