Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automakerโ€™s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasnโ€™t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the ownerโ€™s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldnโ€™t be, damaging the combustion and exhaust systems.

This allegedly causes โ€œabnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.โ€

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customersโ€™ warranty claims even when the warranties have expired.ย 

According to the lawsuit, Hyundai canโ€™t adequately repair the oil consumption problems and doesnโ€™t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, โ€œand in most cases do not receive required engine replacements.โ€

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011โ€“2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles.ย 

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

    I bought a 2016 Hyundai Elantra and have had 2 engine failures since. I was able to find a replacement engine the first time but since then Hyundai stopped manufacturing those engines and I have not been able to repair my car for 2 years now. I am stuck still paying payments on the car. I took it to Hyundai and filed a claim since I barely found out this year that they have had a recall since 2019. They offered to pay 70% of the repair and I will owe over 3k on the repair. I still owe 8k in payments. Smh I donโ€™t know what to do. I missed the deadline for the last class action lawsuit which I was never contacted about.

    I have a 2017 Santa Fe at 127K and itโ€™s started to burn through oil quickly the last few months suddenly. I just got an oil change and at 3k my car was stalling. I brought it in right away to my oil change place and I had no oil! How the heck does that happen. The mechanic person told me this is an issue and confirmed my engine was noted in a law suit. He said he sees a lot of Hyundaiโ€™s coming in with this issue. Iโ€™ve never gotten even a oil light warning. Iโ€™m not needing to track my oil and would like to be included in this lawsuit and Iโ€™ll have more data on oil consumption soon.

    I have a Hyundai Sonata. Iโ€™ve also need a new engine in my vehicle. I purchased my sonata brand new and after 30,000 Iโ€™ve had issues. When I asked to have it replaced I was denied by Hyundaiโ€˜s corporate office I was told that I needed to be fixed three times in order for it to be replaced and now today August 23, 2022 I was denied a replacement also I filed a complaint and they said that they would only pay for 85% when Iโ€™ve been having issues from the beginning I am seeking an attorney now and hopefully they can help me with this issue .

    I would love to be added to the oil consumption suit. I have been having engine issues since 52,000 miles my car is at 85k miles and they refuse to diagnose the vehicle. I have been doing oil consumption test for the longest and they dealerships are not trying to properly diagnose my vehicle! now i have an engine light on and i really have a feeling their tryig to get me to pay and fix the vehicle!

    I have a 2017 Hyundai Santa Fe and the oil just disappears. They oil consumption test every 400 miles my car is losing a quart to 1.5 quarts of oil. They originally told me that after this they would do another test- but come to find out Hyundai said they will not pay for the next test and its all on me. Tried calling my warranty place they wnat me to send it to Hyundai for 30 days in that time they will take apart my whole engine to figure out the problem (IF THEY FEEL ITS THERE fault they will cover the damages) if not i have to pay all that labor & everything out of my own pocket. They will NOT give me a rental for the 30 days so i have no other car to drive. I would LOVE TO TALK TO AN ATTORNEY OR GET IN ON THIS LAWSUIT AGAINST THEM. they sold me a faulty car and they should be responsible in paying for it to get fixed not me! iโ€™m adding oil every 400 miles which now the prices have gone up so its costing me a good $7 every 400 miles!

      Same here with me, Iโ€™m so disappointed in Hyundai. I had a 2013 and never had any issues like this. It was a great car, I shouldnโ€™t have traded it in on my 2016. I feel like Iโ€™m being scammed bc this is anything but normal and Hyundai isnt doing anything to help its consumers. This is how companies get bad reputations and eventually go belly up. All the Dealership wants to do is say trade it in on a newer model. Iโ€™m sitting here thinking, you really think I can ever trust Hyundai again? Seriously we need our engines fixed or replaced at no cost to us. This isnt our fault and we put our trust and money into a brand that claims to be Americaโ€™s #1 warranty. How do I get in on filing for the law suit? Iโ€™ll go all in. This is BS and they need to fix it.

    Was told by my service dealer that this is a common problem with many Hyundai models, just had to add 3 quarts of oil & Iโ€™m only 2000 miles in since last oil change which I do @ every 4000 miles. Need to get in on this class action as my Tucson is already @ 83K miles, the power train warranty expires @ 100K.

    I have a 2013 Hyundai Santa Fe. I drove it off the lot brand new. As soon as I hit a little (102000) past the warranty, it was all my problem. My car goes through so much oil. Itโ€™s a huge problem. Just recently during maintenance, the tech found metal shaving in the used oil. This isnโ€™t my fault! I know itโ€™s all due to Hyundai. I took pictures for a few weeks to show my dad and even he couldnโ€™t believe it. I would love to be included because my 2014 Santa Fe started last fall burning more oil than it should and Iโ€™ve taken immaculate maintenance care for my vehicle.

    I think itโ€™s quite scary how many hyundai sonatas are under this post. My car DIED on me Friday with no hopes of cutting back on due to oil evaporating from my engine . Iโ€™m in disbelief with no way to get back and forth to work. I need to be apart of this lawsuit.

    Mine was a 2016 Hyundai Tucson. Massive consumption of oil: I was having to add 2 quarts a WEEK.
    Finally was told I needed a $10,000 engine replacement, but there were none to be found. I was forced to buy a new vehicle since I had โ€œcatastrophic engine failureโ€ and Hyundai wouldnโ€™t honor the warranty I had bought from EasyCare.
