  • The class action lawsuit claimed a number of Hyundai and Kia model vehicles contained an engine defect that caused them to use an excessive amount of oil.
  • The vehicle owners argued the alleged defect, in addition to costing them money for the excess oil, caused the vehicles to stall and eventually fail. 
  • Court approval of the dismissal was not required as the class had not been certified nor proposed to be certified for purposes of a settlement, according to court documents.

Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automaker’s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasn’t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the owner’s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldn’t be, damaging the combustion and exhaust systems.

This allegedly causes “abnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.”

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customers’ warranty claims even when the warranties have expired. 

According to the lawsuit, Hyundai can’t adequately repair the oil consumption problems and doesn’t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, “and in most cases do not receive required engine replacements.”

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011–2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles. 

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

    I own a 2012 Hyundai Genesis which has bad oil consumption problems. I have to fill up and check my oil frequently. My car is very sluggish And I would like to be added to this class action lawsuit. I purchased my car from the Hyundai dealership

    I was never informed of the previous lawsuit. My car is affected, I’ve had to replace the engine, after the dealer update my ECM, I’ve replaced nearly 10 brake bulbs from an electrical short, my check comes now even after a new engine replacement.

    The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, which i have. I have already put 2500.00 in engine and now its using oil every 1000 miles. at least 1.5 qts or more

    I WOULD LIKE TO BE INCLUDED IN CLASS ACTION. I HAVE A 2017 ELANTRA LIMITED 2.0 ENGINE. USING EXCESSIVE OIL AND NOW STARTING TO MAKE VALVE NOISE UPON INITIAL START UP AFTER SITTING FOR 4 OR MORE HOURS. I CHANGED OIL EVERY 5000 MILES. HYUNDAI REQUIRES 7500 MILES.

    2017 Hyundai Sonata started burning oil. I have to add oil within 2-3 weeks of an oil change.

    If your buying a car here is where not to go. Straub Hyundai or any Straub dealership . This is how they are treating us .

    2014 hyundai tucson with 94,033 miles . It had an original 10/100,000 mile warrant when it was bought . The knock sensor campaign was done with approximately 70,000 miles on it . At that time it was given an extended 20,000 miles . Now with 94,033 miles the engine failed . I took it to Straub Hyundai and they did the required checks and it was a No Pass for main bearings. I sent what they asked for and was emailed on 6-29-2022 that it received a PA (prior approval ) and that they were going to warranty us a new engine. They gave me a rental car at enterprise from Hyundai with the proper codes to get the car . Then on 7-3-2022 Hyundai decides to deny the Prior Approval after the engine was ordered and i had a rental . The dealership didnt even tell me until 7-26-2022 that it was denied to take the rental back i would be charged for the rental and diagnostics of the engine since it was denied a warranty engine , leaving me on the hook for the rental . It had the knock campaign and a P1362 code and the main bearing had failed just like in the class action HMA suite. They said lack of maintenance but it was approved for long enough the new engine had already arrived before they denied it .

    I have a 2011 Elantra that is not involved in the lawsuit but should be. I took it in last Friday because it was stalling out on me and was told it was out of oil. What?, Never had any oil warning lights come on.. There isn’t any oil drips in my garage. What is that about? Now I’m told the engine is no good and I need to replace the engine. I was never warned about adding oil more often. One day I have what I thought was a good car and now I have none. And why did the oil light stop working?

    I have a 2015 Hyundia sonata limited. I was having issues with my Hyundia they had me to go completely they the process of letting them change my oil then bring it in 1000 miles later for 3 time after seeing that I need oil each time they said I should do some type of Oil combustion cleaning which was not covered it was about $700 dollars I ask is that doesn’t work and I do need a motor would I get my money back they said no. I called the corporate office and they said it was what had to be done before it could be submitted. I did let them do it . It didn’t change things they said my motor was bad and that they would summit it. When the answer came back denied. She then going to tell me they usually only approve them if the motor is knocking or smoking they have denied cars that are only Consuming oil . And they have a class action suit going own .My question why didn’t you tell me that before I spent my $700 and let me make the choice if I want to continue. I felt ripped off and betrayed .Not only are they no honoring these cars but the dealership are ripping off the customers having them spend money by withholding information she knew they had a issue with Honoring this problem I should have been told and then decided if I wanted to spend my $700 . Yes I want to join the class act how do I do it .

      I have a 2018 Hyundai Tucson Sport , useing a quart of oil every 1000 miles . I was told this is normal !
