Hyundai makes numerous models of Hyundai and Kia brand vehicles with defective engines that use excessive amounts of oil, costing their owners huge sums of money, a new class action lawsuit alleges.

On Apr. 12, eight owners of Hyundai and Kia brand vehicles filed a class action lawsuit against Hyundai Motor Co. in a California federal court, alleging violations of federal warranty laws.

The Hyundai excessive oil consumption lawsuit alleges that numerous models of the automakerโ€™s vehicles are equipped with defective Nu, Gamma, Theta, Lambda and Kappa engines.

The defective engines allegedly use excessive amounts of oil, stall and eventually fail. The drivers say Hyundai should have issued a recall for the vehicles a long time ago but hasnโ€™t.

As a result, thousands of Hyundai and Kia owners and lessees have allegedly been forced to constantly check the oil levels, and oil must be added to the engines more frequently than even the ownerโ€™s manuals recommend, Car Complaints reports.

The engine issue has flow-on effects like reduction in engine lubrication due to crankshaft submersion and gaskets and seals damage, which leads to oil leaks.

The plaintiffs also claim that oil in their vehicles migrates to places where it shouldnโ€™t be, damaging the combustion and exhaust systems.

This allegedly causes โ€œabnormal wear of engine parts, oversaturation of carbon and deposits of oil sludge, ultimately requiring a costly engine rebuild or replacement.โ€

Automaker should honor warranty claims outside terms, Hyundai class action says

The plaintiffs allege that Hyundai should honor customersโ€™ warranty claims even when the warranties have expired.ย 

According to the lawsuit, Hyundai canโ€™t adequately repair the oil consumption problems and doesnโ€™t offer any reimbursement for out-of-pocket costs caused by the issue.

The class action states customers must suffer through long wait times for replacement parts, โ€œand in most cases do not receive required engine replacements.โ€

The cars with the allegedly faulty engines include the 2012-2020 Hyundai Elantra, 2009-2018 Hyundai Genesis Coupe, 2019-2021 Hyundai Kona, 2020-2021 Hyundai Palisade, 2010-2012 and 2015-2021 Hyundai Santa Fe, 2009-2010 and 2015-2021 Hyundai Sonata, 2011โ€“2021 Hyundai Sonata Hybrid, 2010-2013 and 2015-2021 Hyundai Tucson, 2011-2021 Hyundai Veloster, 2020-2021 Hyundai Venue, 2010-2021 Kia Forte, 2017-2020 Kia Niro, 2011-2020 Kia Optima and Optima Hybrid, 2012-2021 Kia Rio, 2011-2020 Kia Sorento, 2012-2021 Kia Soul, 2011-2020 Kia Sportage, 2018-2021 Kia Stinger and 2022 Kia K5.

Meanwhile, Hyundai has expanded its recall of vehicles with an exploding seat belt part issue that has caused multiple injuries to include 6,240 of its 2021-2022 Elantra and 2020 Accent vehicles.ย 

The plaintiffs are represented by Nye, Stirling, Hale & Miller LLP, Sauder Schelkopf LLC and Walsh, PLLC.

    2018 Hyundai Elantra engine Shut down while driving. We had it towed and there was no oil in engine,which was odd because the vehicle never burned /used oil. Well the mileage is 115k so I basically have no course of action . How does a person sign up for this lawsuit. I know the mileage is over 100k but seriously? 115k? Blown up engine.There is absolutely no reason for this engine failing like it did. We maintained the proper maintenance and now I have nothing but a yard decoration.

      Same here. My car sat for 6 months until I could replace the engine because that was my only car. 2014 Azera with 121k mikes.

      Iโ€™m wondering the same thing. Where to sign up. My 2019 Hyundai Tucson which only have 20,000 miles on it. I was driving down the freeway when my engine shut down. I had it towed over 100 miles to Hyundai dealer. They told me it had no oil in it. Theyโ€™re not sure if itโ€™s covered under the warranty. Itโ€™s been sitting at Hyundai for way over a week now. Hyundai doesnโ€™t know how long they will have it. They are going back and forth to see if itโ€™s covered under warranty. In the mean time I donโ€™t have a car. Itโ€™s ridiculous. Especially with the low mileage.

    Our 2015 Hyundai Sonata had the engine replaced in August 2019 due to this recall. On June 16, 2022 we had it towed to dealer because engine quit, same problem as before. The โ€œnewโ€ engine has about 67,000 miles on it and we are now trying to get it replaced AGAIN! Dealer has had our vehicle for almost 6 weeks with numerous excuses of why they havenโ€™t conducted the necessary tests and sent results to Hyundai. I am hopeful that eventually all will be resolved and we will be reimbursed the almost $1300 we have spent on rentals. I also question if they put the same defective engine in with the hope that we would get rid of the auto. We had regular oil changes done and the oil light never came on during this entire ordeal.

    My 2015 Sonata burns excessive amounts of oil. I get the oil changed every 3000 miles and between oil changes I have to put 6-8 quarts of oil in.

    My 2015 Santa Fe Sport has been to the dealer 8 times in the past year due to low oil (since my initial visit last summer when my car died in the middle of the road).

    Dealership keeps going through the same process: Start 1,000 mile oil consumption test, which fails. Then they do an engine combustion cleaning and another, 1,000 mile oil consumption test, which passes. 3,000 miles later oil very low and the process starts over again.

    Even though the dealership has seen that the engine oil combustion cleaning only puts a temporary band aid on the excessive oil burn problem, they keep saying that is all that Hyundai Corporate โ€œPrior Approvalโ€ Department will authorize them to do.

    I have a 2015 sonata. It burns oil like crazy. It has now stopped running and is sitting at a dealer ship. Theyโ€™re telling me the recall doesnโ€™t cover my engine.

    I have a 2016 hyundai tucson. Uses about 2 quarts of oil every 1000 miles. Iโ€™m constantly checking the oil and I have had all of my oil changes done at my hyundai dealership

    I have a 2017 Hyundai Tucson SCL that I bought brand new 58,000 miles consuming oil very badly you have to check the dip stick daily. Really nice car when I first bought it Iโ€™m the only one who is maintained it I checked your oil daily.

    Does anyone have information on how to file with the class action suit? I have been having an issue with my Tucson, and itโ€™s getting worse. It has been in the shop for nearly 2 months and they will not even give me a rental. Any information would be helpful otherwise will look up lawfirm as well. Thank you in advance

    My 2016 Tucson as been consuming oil every 300 miles or so, quart or quarts low every time I fill up for gasoline. I have never used so much oul in my life time of driving vehicles over 45+ years. Also, at just under 100,000 miles engine starting decreasing speed and RPM ran up to 5 6 rpm before calming diwn, plus compleletly gave out on interested going 68mph to a dead stop. Waited half hour and drive home. Itโ€™s scary to go too far. What can be done about these problems?

    My 2016 elantra started having issues for the timing belt which I was told was for the car not having enough oil in it or not changing the oil timely; but I know I did according to the owner Manuel! And the oil light was always on! Now the camshaft has worn out and the engine needs to be replaced! Itโ€™s just sitting in my garage because I canโ€™t afford to replace the engine!
