Hydroxycut productsConsumers who bought Hydroxycut health supplement product, manufactured by Iovate Health Sciences USA Inc., allegedly based on false advertising and marketing are now receiving settlement checks in the mail from a Hydroxycut class action settlement.

Top Class Actions viewers are reporting receiving checks worth about $97.57 in the mail from the Hydroxycut false advertising class action settlement.

These settlement checks stem from the Hydroxycut class action lawsuit known as  In re: Hydroxycut Marketing and Sales Practices Litigation, which alleges Iovate engaged in false advertising and misleading marketing claims for their Hydroxycut products.

 

The Hydroxycut weight loss supplement class action lawsuit alleges that Iovate made misrepresentations of their products with statements that certain Hydroxycut products were “clinically proven” as an effective and safe weight loss supplement. Because 20 other lawsuits made similar claims against Iovate’s product, they were centralized into one Hydroxycut weight loss multidistrict litigation to better facilitate litigation proceedings.

Iovate denies all allegations in this Hydroxycut weight loss supplement class action lawsuit, but agreed to settle in order to avoid the cost and uncertainty of further legal proceedings.

As part of the Hydroxycut weight loss supplement class action settlement, Iovate agreed to pay $14 million to establish a settlement fund, which would go toward awarding Class Members who bought Hydroxycut weight loss products between May 9, 2006 and May 1, 2009.

The Hydroxycut Weight Loss Supplement Class Action Lawsuit is In re: Hydroxycut Marketing and Sales Practices Litigation, Case No. 3:09-md-02087-BTM, in the U.S. District Court for the Southern District of California.

NOTE: We originally reported that checks were disbursed in another Hydroxycut class action lawsuit (Garcia v. Iovate), but we were unable to confirm this with the Settlement Administrator.

    I filed a claim but have not received a claim check here in the Tampa Bay Florida area as of today July 15th…

    I was told they split the settlement up and some people may not receive a check. Not understanding that. It’s another company that holds part of this settlement. Don’t sound right to me..
