Hurd Inert Gas-Filled Window Class Action Settlement

windowHurd Millwork Company, Inc. has reached a class action lawsuit settlement over allegedly defective inert gas-filled insulated glass windows and doors. If you own a home or property with Hurd inert gas-filled windows and/or doors, you may be eligible to receive a partial refund of the purchase price you paid.

The Hurd window settlement will resolve a 2004 class action lawsuit, entitled Douglas Barden v. Hurd Millwork Company, Inc., that alleged the inert gas-filled insulated glass windows and doors manufactured by Hurd did not retain the inert gas and allowed the gas to leak out over time, thus, reducing their thermal rating and efficiency. Hurd denies any wrongdoing, but has agreed to provide a $1.65 million class action settlement fund to resolve the litigation.

Under the Hurd inert gas-filled window class action settlement, Class Members who file a valid and timely claim form can receive a prorated distribution of the class action settlement, up to a 12 percent return of the purchase price of their Hurd inert gas-filled insulated window and door products.

Class Members of the Hurd window class action settlement include all current owners of property located in the following states whose homes, condominiums, apartment or commercial building have inert gas-filled insulated window and door products manufactured by Hurd between January 1, 1994 and December 31, 1998:

Connecticut
Georgia
Indiana
Kansas,
Kentucky
Louisiana
Maryland
Massachusetts
Missouri
Nebraska
New Jersey
New York
North Carolina
Ohio
Oklahoma
Pennsylvania
Vermont
Virginia
West Virginia
Wisconsin
District of Columbia

To participate in the Hurd inert gas-filled window settlement, you must submit a valid claim form to the Settlement Administrator no later than February 10, 2012. The deadline to exclude yourself from the class action settlement is November 23, 2011.

    I too live in Michigan, built a custom home with ninety nine Hurd windows and full glass panel doors. I had problems right from the start, horrible fit between sash and frame, cracked fixed transoms, seal failures on at least twenty windows, insol-8 glazing was a huge added expense. Promised little or no infrared heat gain or light damage and superior cold and hot insulating. Sun damaged carpet, huge A/C and heat bills. Foil wrap around glazing visible in different places on like windows, black adhesive used in manufacture creeping on to glass. Have gotten complete runaround since day one. Eighteen years later am ashamed of my beautiful home, that I spent my life savings on. Lansing, MI dealer ( Olsen Mastermark treated me like crap after he had all my money). I tried getting competitive quotes from different manufacturers and dealers, when he came in much lower I ordered and paid, had incomplete order delivered, said…oops must have left some off, pay more to get rest, beware of this shiester as well as Hurd. I never heard of any class action for Michigan.

    Our house was built in 2005 with Hurd windows and doors and just today I was standing in the kitchen and heard a loud pop like a shotgun and noticed that one of the windows had just exploded. So I just googled Hurd windows exploding and found this wed site. You would think the manufacturer should have records of who ever purchased them and contact them with any defect notice. This is the only issue I have had so far except one other window with a cracked seal. Never heard of this class action law suit, hopefully nothing else happens.

    Same as with everyone else above, we contacted Hurd on numerous occasions, have a house full of their windows and this is the first I am seeing anything about a class action suit. This is just wrong. Those who purchased Hurd should have been notified once the suit was settled. I, for one, and apparently I have lots of company, never heard a thing until now – two years too late. Screwed again.

    We built our home in 1985 with all wood – aluminum clad windows by Hurd – All the windows on the south side of our home have lost their seal and are all foggy! Looks terrible!! We have tried numerous phone calls and emails to contact Hurd over the years and no-one ever returns our pleas for help! We paid a lot of money for our windows and even though our home is now 30 years old, this should not have happened. I too want to pursue this matter and feel they should stand behind their product! And respond to folks and not leave us hanging!!!

    House built 2004, by 2010 1/3 of my windows lost their gas & look like sh*t.

    We spent over $60,000 on Hurd windows in 1989. By 1996 all of the south and west facing windows which include a 9′ half-round, 2 4′ half rounds, and a 30″ half-round, 1 French door and a total of 25 windows had all lost their seals and turned brown. I contacted the company I purchased them from, and was told there was no warranty after 5 years, even though when we purchased them, there was supposed to be a lifetime warranty. I never was contacted by Hurd or the lumber company about any class-action lawsuits or anything. Through the years I have tried contacting Hurd, and never reached a reply. At this point, the windows look like crap. I can’t imagine it would fall on the purchaser to research every week for decades to find out of there is litigation. Sounds like there were plenty of other people who were left out as well. I am in Michigan, which appears to not even be on the list…really? Last week I sent out another online request to be contacted on the Hurd website regarding the failure, and still have not heard anything. Definitely want to pursue this further.

    I just today saw this site while online to look up a contact # for Hurd because one of our casement windows just cracked and I need to get it replaced. We live in NJ and had all Hurd windows installed in late 1995. A field rep came out around 2002 and drilled holes in all the windows to release gas I now have several windows that have a film between the two panes. Wondering if anything can be done.

    I can’t believe this is the first I’ve heard or this. We have had to replace almost ALL of the windows in our house due to cracked seals. Probablynlike 35 panes of glass
